Had a woman apply for one of my rooms. She moved up here with her girlfriend from out of state and evidently things did not work out so now she is on her own and needs to find housing.

I sent her an application and she sent it back even before I met her or showed her any of the rooms.

I always ask if they have ever been arrested or been convicted of a crime and she replied no

I googled her name from the state that she came from and 10 years ago she was arrested for some drug charges. One was possession and another one I couldn’t quite figure out what the statute was.

So, my question….. Would any of you ask her about this charge or just completely disqualify her.

She replied to most of the room ads that I have so she seems like she needs a place right away. I told her that we have several applicants ahead of her already, which is what I usually say before I screen someone.

I doubt she “forgot“ about that 10-year-old arrest

She is starting off by telling lies. What else has she not disclosed? Probably thinks that you couldn't find it. If you are sure it was actually her I would DQ her.

If she had admitted it up front I might still have accepted her, depending on the severity of the crimes.

What does the docket say about resolution? Did she pay a fine? Did she serve days? Is it for something that perhaps is legal now? I'd ask her about it. Maybe she's under the impression that after a certain period of time it's not reverent. Anyways, yes, I'd fill that room if possible. Ask ... What happened? What did you do about it? What state is she from? Is she from a BLUE state where everything is plead down (except for former presidents where it is plead up?)

There is a difference between an arrest and a conviction. If this is her, she may just claim that you asked about convictions if she was only arrested.

That said if it has been 10 years, I would be more concerned how the plea went and how the fines were paid - providing she has been out of jail for 10 years. I would be more concerned about the lie than the charge....unless it was manufacture of drugs.

Are you sure you have the right person googled up?

Yes, it’s her. The article says she was booked into the county jail for an alleged drug offense. I think everything is alleged until you’re proven guilty.

Here is what the charge was if anyone could help decipher this, it would help.

Thanks everyone! She seemed a bit confused about her living situation. It says on my application current rental address, which she put down, then on the next page it says how long have you lived there, which she put 7 years.

The next question is name of Landlord and phone number and she put N/A, but did put her “Significant Other’s Phone number “on there, so I guess she expected me to call her significant other to get a referral?

So, I look on the assessors database and find out who the owner is, find a phone number, call him and ask about this “Tenant“ of his. He seems confused and when I mentioned her name, he said “oh yes, she was a friend of my daughters“. I told him that this particular person put down that she had lived at your house for seven years and he seemed surprised at that! I asked the usual questions. What kind of tenant was she did she pay her rent, he seemed completely clueless!

So, it turns out that she stayed at his house for a bit, was a friend of his daughters, but he didn’t know if she paid rent or not. Way too sketchy for me.

Not admitting she had an arrest, being a bit, evasive about her living situation, wanting me to call her ex significant other as a reference…NEXT!!!!

A Goole search says that Schedule IV drugs, substances, or chemicals are defined as drugs with a low potential for abuse and low risk of dependence. A sampling of the Schedule IV drug names that pop up show that they are mild prescription drugs used for anxiety, sleep, muscle relaxants, and similar issues. For example, if your doctor prescribed you Ambien to help you sleep, you have taken a Schedule IV drug.

Authorities might properly charge, or either overcharge or undercharge, depending upon the objectives of the jurisdiction.

GKARL's practice of checking for the actual disposition of a case is a good approach.

an arrest 10 years ago is not relevant to me. cops arrest for looking at them wrong. convictions are always relevant to me. however your applicant has enough other issues that I would rely on other criteria. eg: proof of income. --12.232.xxx.xx

We accept minor legal issues after 10 years.

POSSESSION could just be her personal stash and MJ is EVERYWHERE. Her stash might now be legal!

INTENT TO DISTRIBUTE just means she had more than a certain minimum amount.

Police like to use POSSESSION to nail people and meet arrest goals. It's kind of a catch all, like seat belt violations. They were fishing or she leaded to a lesser charge.
