So my tenet is upset about me inspecting her apartment (which needs to be done) and is making it difficult, asking that I give her 24 hours notice. Is she trying to hide something? Why else would you need notice. She claims it’s so she can make plans since she works night shift and sleeps during day but I don’t see why she can’t wake up for an hour to accommodate me. I attempted to do an inspection on Christmas morning as I don’t have plans and I figured she might not either she flipped out saying not only was it a holiday and she wanted to enjoy it but she had strep. I did an inspection while she was hospitalized and she was NOT happy when she got home. I did this before but I was in and out with my repair man while she was at the store. I always thought 24 hours notice was a courtesy and any notice was a courtesy. --136.54.xx.xxx |

24 hour notice to enter the premises is not only a courtesy but also a legal requirement in California and manyy other states. Check it out by researching your CA landlord/tenant statutes. The exception would be in the case of an emergency or specific tenant permission. As to going in for an inspection on Christmas morning, I personally think that's rude on your part Joy. There are 365 days/year of which only a few are major holidays. An inspection can be done any of those other days rather than on a major holiday. --98.211.xxx.xx |

Follow the link above - in the upper left area of this page- Landlord/Tenant State Laws.
Study them & follow them.
Also put yourself in the other person's shoes for a minute & and ask yourself if you (or most people) would find these things acceptable.

My lease requires 24 hour notice. In my first NJ apartment I had a LL like this. He was younger and a teacher at the deaf school. Very self important. I had to deliver the rent to his cottage at the school. He would go in and out of my unit at will. He complained one time that I had left some of my laundry on the floor and it embarrassed him as he was showing my apartment to a friend. It was a four unit building and very drab inside but I had added carpet tiles over the gray kitchen tile and nice w to w carpeting, loose lay. So He raised my rent because my unit looked better. I gave notice and was out in a month. Moved to identical apt. two buildings down. He tried to keep my little wood grain left handed refrigerator saying it came with the building. I spent a weeks vacation stripping out the tiles and returning his kitchen floor to what it was. He was not happy and said I should leave him the carpet. Nooooo. He later bought Mom's midlife crisis GTO convertible and totaled it. Can't make this stuff up. They are out there. I am a California Landlord based out of the Los Angeles area. I try to inspect every of my rentals at least twice a year. I do not make a special trip on weekend to accommodate a working tenant. Instead I give my tenants a phone call, text message, email AND post a 24 hour notice.
Until a tenant gets to know me they don't like having a "Stranger" enter their rental alone. I assure my tenant that I've had rentals and inspect everyone over the past 45 years. That I'm Not Only a Landlord, but also a California Licensed Contractor, Bonded and Insured. This in California, all a landlord is required to do is Post a 24 Hour Notice AND state the reasons. I generally put down:
Landlord/Owner to inspect all units in this Property, including the Unit of Gloria Smith, Number 216, from 10am to 3pm.
I will be checking out all plumbing fixtures, electrical outlets and switches, as well as testing and replacing the back up batteries in each hard wire smoke detector and c/o sensors. I will be checking and providing general maintenance.
I had several new tenants in a large complex contact "Housing" saying the landlord is playing the roll of a maintenance working. He is just snooping around looking to steel undergarments, etc. Then in turn Housing sends me notice that I have to send in a Licensed Electrician to check anything electrical. A plumber to check anything to do with waste, vent and fixtures. So I re- post my 24 hour notice and do my inspection. Then the General Manager of the Housing Department tries to throw the book at me. We meet for a hearing and end up loosing my cool calling him a quack, playing the roll as a City Official, while in fact he is someone trying to extort funds, fees and fines. I was ready for this fight and headed to go before a Judge for "not listening to the a legal City Order".
The judge then throw his book at me and I deflect. I tell the judge that he is "Stupid" when dealing with the City. Because the City told this judge that I'm only a landlord and not anyone who is qualified to make a personal inspection of my own property, and/or make repairs.
So I run down my credentials, pulling out my pocket licenses and certifications. I have more than all of the City Quacks combined, that were involved in my case. A, B, C-10, C-36 and more including Lead, Mold and Asbestos.
All of this just because "Tenants" have the ear of the City. So the next time this happened, a tenant, squatter, etc would not let me enter the unit, changed the locks and filed a false police report, I called Directly to the City Attorney assigned to "Housing issues". She told me over the phone, "I am not here to help landlords, we are here to support laws against landlord for Housing and Police Issues". Then sent three phone offices to arrest for lunging threats over the phone".
I asked the three police officers if they personally listened to the Recorded Conversation I had with the City Attorney. They said no!. Then asked me if I owned any guns. They were also instructed to take them away from me. I told the police offices that yes, I have "guns", around 200 of them! They were shocked. I said a a licensed contractor I have paint guns, nail guns, spray guns, staple guns, etc. They laughed!
So now, after the second year of the 4 year tenant protection scam set out by the city, I NO LONGER LISTEN TO ORDERS, Violations etc. I send back notices telling which ever department they do not know their own laws/codes, and as a contractor with City, County, State and Federal Licenses, I have to adhere to the most important safe code to protect my tenants, workers and myself.
And as a Locksmith, I simply drill out the tenants lock to make entry, replace the lock and do my inspection. The tenant has access to their back door so if they want a new key, they most may my locksmith charge of $100 for the new lock and keys. --47.155.xx.x |

Why can't you go inspect in the middle of the night, interrupting your sleep time?

I can understand why that didn't go over well, can't you, now that you've had time to think about it?

That tells me that you did not give any notice?
It also tells me that you must live in the same building or complex because you know way too much about when this person is at home or not and where they are. How do you know all of this?

So, why not give her the courtesy?
As I look in the mirror, it might be better to know the laws instead of guess at them.
It would serve you well and go a long way with you if you just showed her respect and gave her a few options for a future time for you to inspect. It is even a law here to give at least 24 hour notice. I usually give mine more than that and ask them a time that works best for them. I have no problems getting them to cooperate.
I will read the other responses now as I can't wait.

In California, you have to give 24 hours notice for a non-emergency visit. It’s not a courtesy it’s a requirement. Should the situation have the words, fire, flood, or blood then that would be an emergency and the notice is not required.
