So I have a tenant who is a 45 year old child. I finally have had enough of this very weird fellow and I would like to have him move along. I've never evicted anyone before. Since he is month to month can I just tell him his lease is up in 30 days and I want him to move?

Here are a few factors I will include here:

*He always pays rent on time and keeps the place clean (these are the reasons I've put up with him as long as I have.)

*His rent is below market value, it needs to be raised.

*He has done many oddball things since he moved in 5 years ago. He is just a very odd guy.

*He doesn't really get along with anybody and has gotten into arguments with other tenants and neighbors.

*I don't think he's dangerous, he's just bizzare.

Let me hear your advice....

Agree with above. Make sure you give the 30 days. Don't go into detail. Just a letter taped or registered mail that we are terminating your lease and that X date will be thirr last date of tenancy. If really questioned, most here just say that they are going in a different direction with the property. KISS it. That being said... are you SURE you don't want to jack his rent a fair bit and see if you can stand him a bit more.

Ned. I have grinned and bared it as long as I think I can. I like a clean tenant that pays on time, but the flip side to this guy is off the charts. Not only with me, but others in this small town as well. The local mechanic shop will not work on his vehicle, he calls the Utility department complaining about his electric bill all the time, he called the post office and complained because the mail lady was chatting with his neighbor for 15 min. and she should have been working... the list goes on and on. Please be advised that your lease at nonname Ave will end on 10/6/2023 at NOON and will not be renewed. You have until this time to find suitable replacement accommodations and must be completely moved out on or before this date. The Rental Agreement calls for at least 30 days notice before terminating the lease and you are being given more than 60 days notice.

Your monthly rent payments are required to be paid until the end of your occupancy in compliance with the terms of your lease. Your security deposit cannot be used as rent payment at any time. After you vacate the premises, an inspection will be made to make sure that the premises have been cleared of all furniture and personal items and left in a clean and undamaged condition. All keys to the premises must be returned to the manager when you vacate.

Please call the office at %%%%%%%%% when you are completely moved out in order to return all the keys, remotes, and garage door openers. Move out instructions will be sent separately.

This letter serves as legal notice of termination of your Lease on the property you currently occupy. It is also intended to allow ample time to seek a new residence. Failure to comply with the above requirements could result in legal proceedings to regain possession of the property, which in turn may incur attorney costs and court fees that you would be responsible for.

if I have to evict someone, I consider this a failure on my part as much as it is the tenants.

MTM means you could have raised his rent already.

If you want him out then give him the proper notice. Expect him to not pay that last month's rent as he will be sore at you. Maybe let him know that if he leaves you won't have to file for eviction which will hurt his prospects for another rental.

You do not have to give him a reason beyond you are not renewing. Do not give him any info about your personal feelings. That will cause additional drama and will not be beneficial to anyone.

If he pays on time and keeps the place good then maybe you just need to train him a little. Start with the rent increase. Also let him know that disrupting the quiet time of the neighbors is a no go and could result in his eviction.

Maybe he will straighten up?

After reading the extended response from you maybe non-renewal is your best option.

I didn't go and check the statutes today but I am almost sure that Missouri's say must give 30 days notice but also must include one rent cycle. Big difference.

If rent is due on the 3rd of the month you must give notice on or before the 3rd of the month preceding when you want them to be out.

If rent is due on the third of the month You cannot just send them a notice on the 20th saying you have to be out next month on the 20th.

This would cover the 30 day time frame but not the rent cycle time requirement.

Check your requirements.
