I’m a landlord homeowner who has leased out my 3 bedroom 2 bath +den home to a single man and his cousins since 2010. My tenant is a long-term tenant and maintains the property pretty clean and always pays his rent on time. I hadn’t entered the home since 2017. I had moved to Hawaii, but recently returned and discovered that my tenant is renting out every bedroom plus the den to a different person and converted the dining room into an extra bedroom (5 adults total). His rent is going up 10% in May and I want to ask him for additional security deposit. Don’t know if I should put these renters on an addendum to the lease? I am asking for ALL of their identification ( drivers license, bank statements and telephone numbers) to have in my records. The house is currently being rented about $1000 under market value. If I ask him to move out, I will probably deal with an evection, lose four months of rent plus have to pay around $40,000 for remodeling the house. I did the math and I won’t see a profit until around four/five years. Should I just continue w my current tenants or should I ask for the house and find a new tenant? Any thoughts or legal aspects that I might have missed would be very very helpful. Thank you fellow landlord’s & landladies ! Oý --172.249.xxx.xxx

Depending on where the house is in CA, you may be able to raise the rent by more than 10%, but why would you continue a working relationship with a tenant who has screwed you over?

You obviously have more money than brains because you haven't visited the house in 7 years and didn't think it important enough to hire a property manager to look after the property in a state where all the laws favor the tenant.

Your tenant is paying you a pittance and making money on your investment without your consent. He has modified your house and is stealing from you.

Hopefully your lease has a rule against subletting. However, I bet removing his subleases removes his ability to pay rent.
