Thank goodness I got Mr. Casanova and friend out just.in.time. Good cause just passed in NYS. And by the sound of it there isn't an "opt in" provision for upstate although touted. It is statewide. If you own more than 10 doors, it applies to you in totality. We own 11 so we will probably put the SFH up for sale soon. Pity because they are decent tenants.

In NY a property manager cant do the eviction, there would be an attorney involved.I bet the judge would take the word of the attorney or owner as to number of units owned unless legal aid was there to help the tenant and could prove otherwise but that would probabl involve a search by a title searcher and who is paying for that? NE- story you will find amusing, back in the day the govt mandated that cars could only put out so much emissions so engineers sat around discussing how to get below the required level of emissions and one of them suggested splitting the exhaust into 2 exhaust pipes and the govt people stuck there tester in 1 side and everything tested just fine meanwhile exhaust was spewing out the other exhaust pipe just a few feet away,a car guy friend loves that story.Sometimes it is just that easy to beat them. --74.77.xx.xx |

That’s a good story. It sums up the ridiculousness of a lot of this stuff. Like the good cause eviction and the arbitrary # of 10 units. So a landlord with 10 or less units can evict a tenant without good cause, but as soon as you cross the invisible man made line to 11 or more units, you need good cause? Why? What’s the magic in the #11 that changes reality itself? Nothing, it’s bogus. It’s made up. Either good cause applies to all or it applies to none. Amen, NE. So many laws are like this, it's beyond belief.
I feel the same way about minimum wage laws. Why do we discriminate against W-2 employees? If I own a business, I can work for as little as I choose. Many business owners make little to nothing the first 1-2 years as they "bootstrap" the business off the ground, because they're looking at the long-term payoff. An employee could have the same mindset: work for a smaller wage now in exchange for experience and job training, and get a promotion, get a job with a different employer or start their own business later doing something similar. But no. The all-wise Govt has said, "Thou shalt not be allowed to work for less than $X, even if thou be totally okay with it."

Explain how this will drive up the costs for renters. The bad tenants will get more free lunches at the expense of the good tenants.

Upon reading further it seems they are willing to roll this out to upstate CITIES. My rentals are in a small town so under the gun in my area would be: Rochester, Syracuse, Geneva, Ithaca.

Here is what an Oregonian landlord said on another forum:
"Good cause evictions" has a very bad effect on good tenants. We are small-time landlords of some multi-family units in our little town. Our state passed "just cause eviction" about 3 years ago.
Before that, if a tenant started to become troublesome, not renewing the lease removed the problem and did not cause a black mark on the tenant's eviction record -- overall a very humane way to solve a problem.
Now when a tenant's cute little boy grows up to be a teen age terror, breaking into cars, bullying smaller children and making life miserable for our good tenants I can not get rid of the bad tenant. --64.246.xxx.xx |

What a nightmare. Very vague language. SOme of it specified, such as amount you can raise rent...but basically this all but guarantees that landlords will raise rents annually so they don't get caught in this one.
Although the list of causes for which you CAN evict is long and cover most things you would evict for anyway, there are too many vague words like "reasonable" and "substantial".
There seem to be many workarounds. For example, I'd be willing to move away from my wife and have the rental become my "primary residence" for awhile to get rid of an awful tenant.

In 3 months this will all be forgotten.Several years ago they passed a law saying if you bought a house from someone behind on mortgage or taxes etc and they had all kinds of extra protections, cant even mail to anyone on one of those lists etc.The first deal after that my attorney did all kinds of extra paperwork etc,we waited extra days etc and we complied.Now i bet hardly any attorneys or buyers even know about it.This will be the same.Deals will keep getting done,landlords that know what they are doing will keep buying more and more houses,1% of landlords will leave units empty and occupancy rates will get tighter and as a result rents will keep going up.I am to the point where i cant wait to hear the next protections for renters in NY --74.77.xx.xx |

I admit that although I hate the idea of good cause it doesn't directly effect me (yet) so I won't do much about it.

Oregon instituted a "for cause" eviction only after the tenant had been in place for more than a year. In all actuality, it only hurt the marginal tenants. In the "old days", would just not renew or give a 30 day notice of end of rental. Tenant got to move with a clean record. Now, you give the reason and start the eviction-- shows up on rental record....may be part of the reason there are more homeless.
Let's face it, there is always a reason that you may not want to keep a tenant. Just need to document and follow up. It has made us less willing to "give someone a chance". Black and white, no grey. (ei made us a hard ass) --76.138.xxx.xxx |
