State Specific Question About: CALIFORNIA (CA)

What rights do tenants have to record audio or video of their landlord or repair crews, in the home?

Do they have to notify about recording?

Deeper question-If the tenant is in their unit, along with an outside repair crew (hired by landlord), and the crew manager calls the landlord over speaker phone to include the tenant; AND the tenant just happens to have something recording the repair effort, which obviously then records that 3 way conversation; can the tenant then use that recording in a legal proceeding?

Lease terms give Landlord the right to record in all common areas of the building.

It also states common areas include living rooms and kitchens.

I agree this clears the landlord of any legal repercussions. But do these lease terms apply in a reverse manner?

Meaning because the landlord created a recorded space aspect and duly informed the tenants of the possibility of being recorded even in their kitchen or living room; can the tenant claim that means all parties have been fully informed and bypass privacy rights?

Should tenants have to inform landlords or workers, that they are recording inside the apartment? --12.164.xxx.xxx

I had a T who had cameras in every room. Way freaking creepy in my opinion. T did not inform us, we found out. We told all who entered. Not that the workers or realtors were doing anything wrong, just as a heads up. Watch what you say, don't peek at things you shouldn't in general,etc.. --73.230.xxx.xx

Laws are (should be applied) the same for everybody.

I'm sure tenants & landlords have the same disclosure requirement for this - although I don't know what they are for CA or your locality.

I agree with Jim. Anything they record should only help me in court.

I always work as if I am being recorded and when I had people working for me I expected them to do the same.

Guess I do not understand the question as such. Your lease states that you can record in certain areas of the rental but you are unsure if the tenant can do the same?

Not sure but I think there is a right to privacy stating you can not record in a bedroom or bathroom without consent, even if you disclose that you are recording.

I would not want to record in the tenant's space anyhow. Maybe a multi unit with a shared hallway, storage or laundry but why would you want to record in their kitchen unless it was while you were working? --107.147.xx.xx

All states are different but in CA audio and video recording are legal unless you are recording a confidential conversation. There are other limitation but in general cameras used for security in a living space will probably not qualify as eavesdropping. --208.102.xxx.xxx
