I'm upgrading my apartmment building with new vinyl siding.

They started the work on Tuesday (four days ago) and plan to finish on Wednesday working straight thru the weekend.

Tenant just texted me and said if they continue to work thru the weekend, he wants to rent a hotel room and deduct it from the rent because there is too much bangning going on.

.

Am I obliged to let him do this?

We apologize for the noise but are working with the contractor to get this job finished as quickly as possible. The crews will be working through the weekend taking advantage of good weather. Although you may choose to leave for the weekend, rent is still due in full on May 1st. Thank you for your cooperation.

I am not a lawyer but was curious about the scenario and found this description on a website about a MA landlord renovating a neighboring unit: Your landlord is allowed to do construction in the other units. Generally, noise that occurs during the day and isn't in violation of Boston noise regulations isn't going to be a breach of the covenant of quiet enjoyment, and will be considered legally reasonable. Unless the construction is preventing you from using part of your apartment due to obstruction, dust, etc. there's likely no legal violation here. It's unfortunate that your roommate works nights, but your landlord is legally allowed to do construction during the day.

Based on that, just make sure they start and end with any noise ordinances where they are working. --73.159.xxx.xx

I agree with Still Learning.

Do not ignore- idiot tenant will rent hotel & deduct it from his rent. You will then have to go after him to get deducted amount.

You have to address it and let him know his FULL rent is due. Use what Still Learning wrote but add in FULL rent. --160.2.xxx.xxx

Scott,

This is addressed in a proper lease. If not in your lease you need an upgrade.

The crew is not banging on HIS apt every day, all day.

My lease is clear: Management does not provide alternate housing during repairs or emergencies such as power outages.

I find that a courteous reply about us working to make their home nicer usually solves the issue.

Every LL must read the book 'How To Win Friends And Influence People'. It teaches how to do this.

If I pay for your hotel room, I will need to raise your rent. Not only will you be getting a nicer place, I will not be raising your rent further in 20204. However if we pay for your hotel room, we will need to recoup that cost this tax year.

This should be in your lease. Ours had a clause that permits us to do work during "normal hours" and this may cause a temporary inconvenience for the tenant. Tenant hereby agrees that no monetary renumeration will be requested for such events.

We had one unit that had tree roots growing into a sewer drain. Each year, in spring, we would put RootX in there. The instructions for RootX state that you cannot use any plumbing fixtures for at least 6 hours after the treatment is done. I made CERTAIN that any tenant knew this as part of the lease signing. We would send the tenant an email and allow them to select which day next week would work. I'd enter the house at 8:30, put paper notes on all faucets and toilets, do the treatment, and leave.
