One of the rental applications is for an attorney and his fiance. I feel a bit uneasy about renting because of their demeanor. I prefer not to select them as tenants.

Would I be in legal trouble if I said no? Neither one of the applicants is in one of the protected classes. Thank you for your help. --172.56.xxx.xxx

You would not be in trouble as attorneys are not a protected class, but they do know how to sue and because they could do it for free and probably know the judges, they might do it just to cause you trouble.

Have they actually applied with all the requirements met? Can you find another reason to deny them?

the only time I have ever rented to an attorney is when they needed an office to set up a small practice after coming out of school.

Me? My screening checklist does not approve anyone in the legal profession or law enforcement.

Maybe 100 LL have an OK experience with these folks BUT the ONE who rents from you can make your life miserable and cost you THOUSAND$$$. Russion roulette with a bullet in the chamber.

Legal beagles know more about the law and have personal connections with judges, etc. They don't have to pay an atty.

Cops are trained to NEVER BACK DOWN. They also have a 75% divorce rate and 15% suicide rate.

A game warden slipped thru because he worked for "Dept of Natural Resources". He had the authority to arrest State Troopers and to carry a gun on an airplane. He was a mean drunk going thru a divorce with guns and authority to shoot people. The neighbors thanked me when we finally got him out.

BUT

I searched google - In CA SOURCE OF INCOME is a protected class so you will have to find another reason.

Those kidders are NOT a protected class, so you're not required to rent to one of them, attorneys. Each time I had an issue with one, they got free legal help, I had to pay for my own attorney, very costly.

Case in point. I rented a beach front apartment to an accountant, who I got along with for 9 years. But he went to night school and passed the Bar Exam, becoming an attorney. I learned in law school, that he could play games and not pay rent, living rent free, up to 1 years. This was a decade before the pandemic and there were fewer laws protecting tenants from eviction.

It took me 7 months to get an order for eviction. And with his rental savings, he purchased a convertible car. He parked it during the day in other tenants spots, those who worked, yet still had his old vehicle parked in his assigned space.

Having lost 7 months rent and another month until the Sheriff's did the lock out, I was going to be out around $20,000..

So I had a main drain drip in a 4" toilet line over another tenants vehicle. So I sent that other tenant a notice that I was going to snake out the line on a Monday Morning when he was at work, not to park in spot from 10am to 3 pm. Of course this was my attorney's favorite spot to park is new convertible, with the top down. So when I noticed the attorney parked in that spot, I sent him an email telling he had to move. Then I ran my huge snaking cable machine down the line and split open the pipe, causing all of this 10 unit property's sewer discharge to drop into the uncovered car. Now this attorney who acted real crappy had a car to match his personality. --47.155.xx.x

About 15 years ago another LL friend told me told me we COULD reject an attorney applicant because they are "known litigants".

This dovetails with everyone's fears here, was credible then, and I wonder about today.

I concur with the others, especially because your gut is telling you something.

Lawyers know the rules of the game. We do not. I've been involved in two lawsuits lately. In both, I was in the right and the judge ruled in my favor. It still cost me $$$$ to defend myself (couldn't represent myself because the properties were in LLCs). Don't do it. --104.230.xxx.xxx

You are in California. If source of income is a protected class in California, you can not reject just because he works as a lawyer.

I'm pretty sure that marital status is a protected class in California, so you can not reject for them not being married.

I am also sure that roommates can qualify with combined income. You can't make each individual qualify on his own. --76.178.xxx.xxx

Attorney One before I was involved with the units decided not to pay Mom for months and she was afraid of him. He finally left. Attorney Two got even with downstairs tenant by filling the front yard with dog poop. His dogs also scraped the wood in the kitchen on the door frame and he covered that with plaster when leaving. I found it. Then when he was leaving he insisted I meet him on my dark street one night. I went out and talked to him at his car. He was concerned that I might report him for being late with rent one month and he was desperately trying to get a mortgage. I told him I would not do that and he relaxed. I think he was going to shoot me if I told him I would report him. I think he had a gun on his lap. Body language. Next attorney was disbarred, he admitted. He had part time custody of a small dog. He was separating. I found his wife wandering the neighborhood looking for his apartment. HE had given her the wrong address. He wanted to not pay rent over the summer while he was on vacation in Turkey and I said no so he left. His dog had 100% peed all over the carpet. Just not normal. Google says: "California has a law called the Fair Employment and Housing Act (FEHA)1 that protects people from housing discrimination based on protected characteristics, including the source of a housing applicant or tenant's income."

Just because their lawyers don't assume they know the L/T laws. There are VERY few lawyers that deal in Landlord Tenant laws because there's no money in it. I would have no issue if they meet the qualifications. I usually have to explain the laws to THEM. Worst case you file and win they appeal and you then hire a lawyer. --24.115.xx.xxx

Don't automatically assume that profession is not a protected class. In Philly, source of income is a protected class, so banning lawyers would get you before the Human Relations Commission on a complaint. --73.141.xxx.xxx
