Sent the sec dep to Mr C as he had a valid change of address with the post office.

Mr. H contacts me and says that Mr. C won't cash the check with his name on it and won't split the check so Mr. H wants me to split the sec dep and give them each their "share."

I said no; that the receipt had both their names on it when received and they signed the rental agreement joint and several so they'll have to work it out amongst themselves.

At move in tenants get written info on how security deposits are returned. A month to two weeks before move out, that info is given again with a paragraph regarding return of security deposits where it outlines "one check will be given to all noted on lease, division of the check is to be worked out among yourselves."

Not only would I have blocked them both but I would see how to make a check only valid for XX days.

That way if they keep bickering and drag it out they lose out.

The last few security deposits I've had where they went their separate ways the bank cashed the check with just one signature even though I wrote it with AND between the names. Once C figures that out, H will be calling saying he was swindled by C. Block them both now before it degrades further. --209.205.xxx.xx
