What would you do?

You have bad tenants and serve them notice to vacate.

When you get the call from a prospecting landlord, do you:

A. Tell the landlord they are great tenants because you want your bad tenants out asap.

B. Tell the landlord how horrible they are. Ie I would never rent to them again, late payment, violates lease agreement left and right, they get aggressive with you, get drunk, do drugs and smoke in the house, hoards, unclean, bed bugs x4, let's all thier friends sleep over.

Bad tenants have never given me as a reference. They have a friend pretend to be their landlord and give them a good reference.

But when another landlord calls me, I tell him the truth, the same as I hope he would do for me.

Your bad tenants will find a place to move to without you giving them a good reference. After all, you took them and they were bad tenants at the time you accepted them. Lovely tenants do not turn into bad tenants as soon as they move into a new rental. They have been bad tenants all along. --76.178.xxx.xxx

Adding this: if they were bad, I would tell the landlord that I can't give a reference unless they provide me with a copy of the tenant's permission to check references because I would want to be able to legally defend myself if the tenant got mad at me.

Most landlords can take a hint and if they actually provide me with a copy of the permission, I tell them the truth. No personal opinion, actual facts about the tenancy. Late with rent X number of times, smoke odor in the house, whatever the serious lease violations were. Not your personal personality conflict with the tenant. --76.178.xxx.xxx

I have received some negative reviews. Usually I find the issue is somewhat on the landlord for not have any management skills. This can work on your favor . Can you speak in "code" something like "Ive had some trials with this resident, be sure to explain your explanations clearly both verbally and on paper and stay on top of them and you'll be fine" something like that. I find other landlords have resources or tolerances that I may not have and what doesn't work for my business plan can work for someone's else. --172.59.xxx.xx

I won’t lie but I might ask for a paper with their signature allowing me to talk with the landlord. Even with that I do not flap my lips or offer information. I respond to questions that are asked and if it’s not clear cut non-payment or outright damage, etc. I might say I am not comfortable answering that question. A professional landlord doing due diligence will ask the right questions, ask in a different way if they don’t get a straightforward positive response, read between the lines of an unanswered question or end with would you rent to them again? There are times where I can freely admit they were not a good fit in my multi-family with thin walls but might be fine in a single family. --73.159.xxx.xx

They hardly ever contact me, but a couple have when a good tenant was leaving me.

Either way, I'll tell the truth once I have their permission to share info.

The whole truth, no playing "read between the lines".

Type "A" landlords really irritate me. That is why you can't put much weight on information from the current landlord. You need info from the previous landlord.

I added on my application a line stating that applicant gives permission for me to check references including landlords, previous or future.

I tell the truth, but seldom get inquiries. I've not gotten a call on what I would say were my worst tenants, and most of my tenants, leave because they bought a house. I find when tenants move to their own house, they don't clean yours very well. They are too excited to clean and fix their new house up. --75.11.xx.xx

OREO, that happened to me last year.

Small claims maxes out at 10k. I stopped my accounting at 18k, just in case the judge decided to not allow something. This was for materials only.

My collection agency has a lien on her house. Might not matter but if she tries to sell or refi I am in line. --107.147.xx.xx

There was some case law about doing incomplete employment screening that resulted in rape and murder committed by a Dominos delivery driver in the early 00's. I would have expected a follow case could develop if someone lied and as a result someone getting seriously hurt. That hasn't happened - at least not yet.

I try and follow the high ground. That said, how often does a piece of work that you are tossing out actually follow the rules suddenly? Most times they create their own narrative and references.

If I am tossing out anyone - I try and look in the mirror. I failed the tenant somewhere or somehow. If there is a pattern of this, you are costing yourself money or trying to create a soap opera --24.101.xxx.xxx
