Did a non renewal for Mr. Casanova. Mr. C asked for more time which he didn't use. Did the exit inspection 4/1. Only Mr. C was there for it. Mr. C's Roommate, Mr. H claimed he knew nothing about the non renewal but had already moved in with his girlfriend.

Earlier Mr. C asked that the entire sec dep return be made out to him exclusively.

When speaking with Mr. H, he stated he and Mr. C had a "falling out." Mr C. has a new apartment in the city. He also claims that he was the one who footed the entire sec dep from the onset, not Mr. C.

It was mostly Mr. C who was violating most of the lease provisions and whining about next to nothing. I should add that it was Mr. H who showed up at the inital apartment showing as Mr. C was "in the shop with his car."

I should also add that Mr. C is the one with the lower credit score and who had a burglary charge in his youth 10 yrs ago.

They are joint and several. Should I send the sec dep return with both their names on it certified to Mr. C or Mr. H since they both have different forwarding addresses? In addition, Mr. C is of a protected class whereas Mr. H is not. Around here in BLUE NY, that may make a difference and could be seen as "discrimination" should I send the check to Mr. H.

Make it out to BOTH. Send it to one ( most responsible would be my choice). make two photocopy--keep one and send other with "copy- not for deposit" written on it tothe other tenant. Do not send certified. Send with a "certificate of mailing" and attach to your copy of the check that you keep. Proves when it was mailed.

Of course, include accounting for any deposit kept- send to both.

EVERYBODY, all of us, are in a protected class. Treating someone differently because they are in a protected class is the very definition of discriminating. The relationship stuff, all of that drama, is not a landlord's concern. Two persons signed the contract, two persons will be named on the security deposit return. They sort it out. We are not drama police.

Thats just it Phil. Neither of them seem very responsible Mr H may be responsible by just a thread but he did not put in a change of address officially. I had to ask him for his forwarding address Mr C put in an official change of address to the post office.

Not that that makes any difference...the local mail cartier who is probably a third grade dropout, ontinued to drop mail into the mailbox although admitting they received a change of address for Mr C.

Jason, if I did that then the check would show back up at my PO Box as unclaimed. And then it would be my money and my circus...again.

MC, Yes I am going to put both their names on it but my question was WHICH tenant to send it to.

I think I will take a chance and send it certified/signature required to Mr. C (with both of their names on it) as he was the one who officially gave a forwarding address to the post office despite him being more devious than Mr. H, whom I hardly ever heard a peep out of the seven months they were there. --64.246.xxx.xx

Make it out to both, agree with above. Be sure to write on the Pay to the Order of line "Mr. C AND Mr. H". The bank is SUPPOSED to have both people sign before they cash. Not all do as it can slip by sometimes. However, it helps to take the liability off you. If you write "Mr. C OR Mr. H" or you write "Mr. C, Mr. H" they only need 1 signature. If it is not stated specifically, it's an implied "OR" to the bank. --45.17.xxx.xxx

I have a relinquishment of possession form everyone is supposed to fill out and sign. It gives a space to put forwarding address for security deposit accounting return. For a roommate scenario it states that the check will be in both names and returned to the address listed on the form unless other instructions are provided with both people signing agreeing to anything different. If they don’t fill out and leave the form the check is in both names and mailed to the apartment. If I needed to pick 1 address to mail it to, I would choose the person who had been the one I had the most contact with and then mail a copy of the check and accounting to the other person. --73.159.xxx.xx
