Does anyone know if title insurance covers you. If the house/building was built on electric companies right of way.

Have not received any official confirmation yet. But i went by one of the rentals today. The property was being surveyed by the Power company. I knew they had an easement that ran thru the backyard.

But according to the guy I spoke with. They are pretty sure part of the house was built over the easement. No power lines are under the house.

The easement is for a strip of land about 200 ft wide that runs behind a street of homes. In the middle of the land is where they have large power line poles. My house just happens to be set back about about 20 ft more than the rest of the homes.

This was a foreclosure I bought 20 years ago. We did not get a survey. But did buy Title Insurance. House was paid off about 10 years ago.

Any ideas on how much trouble I am in with this one.

As for the reason.

The guy said they sometimes will just replace some of the steel towers or poles after after a certain age. He said these where about 50 years old.

It has the steel towers running for miles behind these homes. My guess is for the very high voltage.

Then a row of wooden poles running along the side of these.

And he said it is even a small chance they are just updating the survey. Because he said the power company is a good customer. And they never mind spending money, no matter what it cost.

But I did talk to a neighbor later. He has some portable wooden sheds at the rear of his backyard. And they are requiring him to have them moved. And allowing him $200.00 per shed to help with the cost as a courtesy. --73.251.xx.xx

You say you bought the house about 20 years ago. Just how old is the house. How long has the house been on the property (easement) and the electric company has not said anything about it.

Look into EASEMENT BY PRESCRIPTION.

I acquired some land back in “early days” maybe 1996 or thereabout. About 5 years ago I talked to the electric company about moving their poles that was on the property. They promptly told me even though they do not have a written easement they have an EASEMENT BY PRESCRIPTION and could leave their poles there on my land without having to move them.

So, I told them I was delighted to hear about the EASEMENT BY PRESCRIPTION because the house I have (only a corner) is setting directly over there main water line into out town. It has been there since around 1950 and they have not said anything about it so I guess I also have an EASEMENT BY PRESCRIPTION and do not need to move the house.

I haven’t heard a word from them about either of the issues.

Our house has a garage apartment that is over the back easement by about a foot. we casused a stink about it when we found out about it at closing, but our realtor told us to quit worrying about it. In our case, the building is older than the easement, probably. When the City decided to replace a couple of poles last year, they used a giant crane to lift the poles over the backyards and fences, so no one had to move a thing anyway. --50.230.xxx.xxx
