STATE SPECIFIC NY

Went to the local LL meeting last night. Fairly top notch attorney as guest speaker.

All those in NYS, Get rid of the term "additional rent" such as utilities will be deemed "additional rent." Apparently when judges see this phrase, they will throw out your eviction case.

Get rid of "LL gets reimbursed for their attorney fees." This immediately becomes reciprocal. The judge will be more likely to grant tenant's reimbursement of attorney fees but not the LL's.

"Good Cause" is looming which is defacto rent control/moratoriums.

A local upstate town was targeted with a "vacancy study" and therefore the state imposed the less than 5% increase fown-wide on them after fighting to get it reversed, the state prevailed.

Winter Eviction Bans has cropped up again. Seattle already has this so if you like clogged courts and tenants stiffing the LL, you'll love this.

Immediately contact your local representatives about this ridiculousness--then find a way around it when it gets enacted.

Or you could move out of state but how long until this craziness infests another so-called "safe" locale? Florida is in deep doo doo if Mr. DeSantis leaves as governor.

Nothing good comes from a judge reading your lease ... ask me how I know.

In my hood only "rent" can be charged. No "fries with that". And security deposit "rules" are so prohibitive I only collected last months rent.

If I was a New York landlord I'd sell it all and move my investments to a better state or country.

Around here I haven't seen the invaders from across the border yet in my town but if they show up I am immediately selling out and moving my investments to better places. I will not subject myself or my family to this. I have advised the rest of the family to do the same wherever they are as well. I have a hard time seeing how landlords in the big cities that are having huge problems with this are not just selling out and going to other better places.

Yep, no "fries with that" here either. Sec Dep is one month's but I heard rumblings of exceptions with that and also rumblings of expanding the strict 14 day sec dep return for 2024. For that "crumb" they will institute "Good Cause" and "Winter Eviction Bans."

I just read one of my clauses where unpaid utilties left over (such as water/sewer) will be deemed as "unpaid rent." I guess that has to be stricken as it is the same as "additional rent."

Attorney also mentioned that if you have an unpaid rent eviction case going and the tenant offers you a partial, you have to say that they will need to present the rent at the court hearing to keep from having your case thrown out. --64.246.xxx.xxx

Maple leaf,

I believe you are right, not just for me and Michigan landlords but also those in states controlled by those who want this stuff.

I am already preparing for the inevitability of it and have been reducing my rentals. I am ready to sell every last one instantly if it gets worse and I'm reducing the count as fast as practical.

Maybe I'll go to more commercial stuff or just vacant land and harvest timber as there is some reasonable money in that if done right. If not that, I'm considering other countries where this madness is not part of their culture. --172.58.xxx.xxx

My lease has always stated that winning party does not recover lawyer fees. Additional rent language has been part of the language since 2019. Hopefully there is a silver lining w the winter pause. They would at least have to keep the heat on and in their name. --172.59.xxx.xxx
