These applicants are getting wilder everyday. Now I have one that just got evicted a few months ago. She’s says it was due to domestic violence , but also says it was a few years ago. It’s my understanding that a LL in MA can’t evict a domestic violence victim. The fact that she’s lying about the timeline tells me a lot, but I need to tread lightly here. This is a new one for me. I’m certainly not going to just believe every eviction excuse. This story seems to have some holes in it.

One time had a boyfriend beating up girlfriend where second day that was not to continue where called the police then that night police arrested boyfriend then boyfriend was never allowed back into building. She found through the police that I called where she continued to be problems. In the province of Ontario the baseline is a credit score of 700 and above where below will keep looking. The reality in Canada and in the United States is that vacancy rates are at one per cent or nothing at all where rental housing providers are screening out problem tenants who have unpaid utility bills along other unpaid bills so they are out the private sector rental housing market. Here it is housing as a last resort where no credit check which is Community housing which formally called the (Housing Authority). So in the end the trash out rental units along rent arrears has to come to end. There are proposals to bring the default eviction where the tenant can stop the eviction by paying the rent arrears where it is done in mail no hearing. There is such large backlog of cases for hearings where this once done in the province of Ontario. The extreme left wing tenancy advocates say this is going to mass evictions where the amount of evictions before the Pandemic was at 2 per cent. Some of government funded tenancy advocates own their own houses where move some squatters in with free utilities then see if housing is a right where wonder if they would evict. It probably not worthwhile to run a credit check. No evictions for any reason. Period. There are lots of ways to solve issues with your unit or your landlord or your rent or your life with an abuser - not paying rent or damaging the place so that your LL has to evict you to get rid of you are not valid reasons.

PLENTY of tenants over the years who have had issues of one sort or another. And they have left without my resorting to a legal eviction.

Life's too short for that stress, and I choose to sleep too late to get up in time for court. Screw that waste of my time.

Two years ago, against my better judgement, we rented to a girl recommended by one of our tenants. Her BF turned out to be an alcoholic that beat her. I could hear her screaming and called the police but she lied and denied it because she was afraid of him. She ended up leaving and it took us 2 months to finally get him out. I still have his cats, he was the "gift" that keeps on giving. But we've had a nice couple since we remodeled it, paying a little more rent and I thank God everyday that he is gone! Once burned, twice shy. Any semblance of drink, drug, or violence in history is a big NO for me. --216.126.xx.xxx

Based on a VERY quick reading of MA law, it seems that there is some provision for a VICTIM of domestic violence to terminate a rental agreement, but no defense from eviction for such victims. So, it would seem that your prospect's eviction in NOT for the reason of being a victim.

Also be mindful of moving a recent DV victim in as the majority of the time they allow the abuser back.

WMH, there are a couple people in my area that file evictions instead of talking. Since I know of this I look closer at the court cases and see if there are damages owed. Rents are low here compared to many other places so if I see 3k in damages it isn't from a month of not paying. --107.147.xx.xx

RentsDue, in MA a legitimate domestic abuse situation can be used by a tenant to terminate their lease. As Moshe [CA] suggested I don't believe that it can be used as an excuse to prevent the LL from evicting. With that in mind, I don't think that I would want to appear before a judge to push the issue.

I'm sure that it would be relatively easy for you to find another reason to not accept this applicant. One of the items in my screening criteria states that I will not accept an applicant who has caused a previous LL to spend money to terminate their tenancy. --96.233.xxx.xx

Before I even contact a potential applicant I run their name through the court database (I have their name from my Google pre-screening questionnaire). In this case I would have seen the eviction and never contacted them. Saves a lot of headaches. Where in MA are you located?
