My tenant reported mold growth in rental unit. They complained their cough is related to mold. Inspection found some minor mold growth.

I ordered mold treatment immediately. And I paid them to live in hotel for one week. Today I received their attoney's call asking for my home owner's insurance. I think they are planning to sue me and want to extort money from me. What can I do?

I had a tenant years back that fell into an open water meter pit. Her lawyer wanted to sue me as well as the city. They sent a request for my insurance info.

I called my insurance guy and he said don't tell them anything. If they move forward make them work for it. In this case they never did.

I live in Indiana and we have mold and mildew everywhere in small quantities. Someone would have to prove a toxic strand, and then they would still have to find me because I would never knowingly allow mold in my places. --107.147.xx.xx

I did my undergrad internship at the San Diego County Apartment Association in the 90's. Back then air quality was just starting to become a L/T issue. You might want to google up Ca Air Quality Laws. Of course, it probably is small amount of mold causing ALL breathing problems and not smoking all the legalized pot the state has to offer. --24.101.xxx.xxx

Peter,

Do NOT talk to ANYONE other than YOUR atty! Be aware there are more attys than there is work for them so some will "create" situations to charge a fee.

Know they have pictures and a mold test kit with ugly growths.

I set test kits in the bed, bath, and back porch. They all looked the same.

Document your timely response and treatment.

What does your lease say? This is a common , everyday issue in LLing.

My lease is clear: Resident has inspected the home prior to lease signing and is satisfied with any health issues such as allergies, asthma, etc related to the home.

Resident agrees the home has been professionally cleaned an is satisfied it in habitable.

Mold and mildew are everywhere, inside and outside. The Health Dept recommends cleaning any mold or mildew with household cleaners. Such cleaning is everyday housekeeping and is the responsibility of the resident.

These clauses have helped me MANY times.

BTW when the smoke clears and at the advice of your atty, this person needs to go.

Hang in there - these usually just evaporate...AFTER you pay YOUR atty.

Peter, as others have said it's time to lawyer up. When you do discuss this with your lawyer make sure you discuss the possibility of counter suing the tenant for not bringing this to your attention sooner & for not keeping the place clean with normal everyday housekeeping. --96.233.xxx.xx

Last time I got one of those attorney letters representing a peep I IGNORED IT BUT I notified my insurance company. And they sent a rep out to get my side. Then the rep said notify me if/when you get a court subpoena. Which never happened. --198.168.xx.xxx
