Hi,

As the owner of record for a property I received a letter recently from an attorney asking me to verify residency for "Mary Smith" including asking for phone number and employment information.

From looking online, this attorney works with creditors.

I've never gotten a letter like this before. My assumption is that I'm not obligated to do anything, but if you've received one of these before, did you bother doing anything, or did you completely ignore it?

If I DO decide to do something is there any liability, since the attorney (obviously) didn't bother including any sort of signed released from Mary Smith to permit me to do anything?

I would throw it out and maybe even inform the tenant.There is no way i am helping a tenants creditor garnish there wages or take funds out of there bank account,as far as i am concerned they need that to pay rent.In my office I have a dont cut our own throat policy --73.177.xxx.xx

OK. Great responses. I agree. Now.. next fly to throw into the ointment...

I've never heard of Mary Smith. Mary Smith has never lived at the property, at least for several years. (unless they were not on the lease.. which I don't think has happened because I keep a pretty close eye on things)

I'm likely going to just toss the letter, but at the same time, I don't like people who don't pay their bills and meet the obligations to which they have agreed.

OBVIOUSLY I wouldn't make anything up. What a silly suggestion. But, I could choose to help the attorney out by letting them know they are barking up the wrong tree.

When I do it's for past tenants that I've evicted. It's usually general questions. Do I help them ABSOLUTELY!

However, just because "Mary Smith" may not have resided there she may have some sort of relationship with who does or did reside there. I had a tenant that had the same last name as I do many years ago. I started getting phone calls asking for other people with my last name. From time to time I still will receive a letter or a phone call asking about it.

I am not, was not and never will be related to that tenant. The only thing I had in common was that I owned property that they rented and they happened to have the same last name as mine.

The letters... I just threw out. The phone calls I would either hang up or advise them that I was not related to the person and to stop calling me.

You have two choices with that letter. You can either throw it out or you can write back indicating that you have no idea who this is. Just pick one. --69.201.xx.xxx
