Tenant who came with the duplex purchase, filed bankruptcy 2x to avoid eviction(both dismissed) was re- served eviction complaint. Paid 1x in 5 months. Last night saw on our camera (aimed at parking lot only) her removing an appliance out of the property (it's not hers). Called the police. After they left, she screamed a threat directly to the camera of coming to my house to snuff or stuff me. Called the police to our house and showed the video. Their Sargeant on duty said that's her freedom of speech.
Why can't they take action on that? She yelled my address in her threat. Besides my personal safety I'm concerned nothing will left when she leaves. And we're trying to sell the property because it sucks being a landlord in vineland nj.

First get a copy of the incident report from the PD.
Then write a letter to the Chief of Police and send via Certified Mail with Return Receipt. Describe the situation and close with a request for a face face with Mayor police chief and officer in question.oh...make.copies of the video.

I am with the above. Officer may not want to get involved but IF something happens, they have been notified. Isn't removing the fridge theft? On the plus side, maybe she is moving this time. It is kind of sucking to be a LL in many states.

Ken and DJ. NJ requires the owner to disclose a number of things to any residential tenant of 90 days or more.
One being owner(s) actual street address - no PO boxes.
Corporations or LLC's MUST list all officers/members AND their home addresses.
And as an aside, stealing an appliance is NOT protected by the civil landlord/tenant relationship. It is a police matter.
Yurbridge - for what it's worth - I'd get a 3rd party to go there and make some kind of good-will cash for keys offering - today.
2,3, or 5,000.00 might be a bargain compared to the damage you might sustain. You're unlikely to get justice from this low-life but you might concentrate on minimizing the damage to your overall bottom line.

DJ it is impossible to "hide" in a small town. You run into your tenants at the grocery store, working at Home Depot, waitressing, etc.

Don't be so quick give the govt info. HOME address or MAILING address? Set a mailbox on a rental or a storage garage. Work a deal with your insurance agent to you their business address.
Our rented mailbox at The UPS Store counts as an official USPS address and is not a PO box.
Don't use your real name when dealing with prospects or residents. I use a common nickname.
I see our residents is the store. They say HI using my nickname.
Biggie: no need EVER to confront irate residents face to face. It only leads to arguments.
Ask the police to visit her - "We are aware of your threat and have it on record." Or pay an atty to write her a bulldog letter.

thank you to all who have offered comments and resources. We did speak to an attorney who strongly suggested we contact the county prosecutor's office regarding the threat.
As for eviction, in NJ the most predictable way to evict is for non-payment; the tenant was in arrears 1 month, we filed after month 2 was unpaid, and got a court date 2 months later. The night before court, they filed bankruptcy (again). They had done the same thing the year before to avert eviction. Now that the bankruptcy was dismissed again in Feb,(failure to comply with court requirements, paying trustee, insufficient income for payment plan, etc.) the eviction is reinstated, but now I'm 5 months with no rent; they paid 1 month to maintain the eviction stay. This just happened on Saturday, so we've been busy getting police reports. I'm grateful I found this forum and for your remarks. --173.61.xx.xxx |
