This is a follow up to my previous post about non-lease student living at one of my rentals.

I spoke with the girlfriend and boyfriend. Before I met with them, here’s what I emailed them:

“What I wanted to discuss with you is that, in the past few months, when I've been at the house, John is there, and you can correct me if I'm wrong, but it seems that he basically lives at the house. If that is the case, it is not fair to the people living at the house, that he does not pay rent. I think It would be fair to everyone at the house if he either pay rent, or he not live at the house. It would be ok if he pays rent and lives at the house, as this does not exceed the maximum legal occupancy of 15 persons.

Per the lease (see below) there is an $800/month charge for unauthorized tenants. If John either starts paying rent or moves out, that charge will be waived.

We can discuss this when I come today.”

The end result is that John is now paying his share of rent and the other tenants are happy they got a rent reduction.

Below is my original post on Dec 19:

I received the email below, from one member of a my 14-person student house, saying that non-lease students are staying at the house, not paying rent and taking up refrigerator space.

I rent to them on a single lease, so technically it’s their problem, not mine, and I shouldn’t get involved. But I would like to help if I can.

Any thoughts on how I could improve this situation? I do have ring cameras and maybe could identify the freeloader's cars parked in the driveway, and send them a notice to remove these cars.

What would you do?

Before I take further action with this, I would like your advice on what to do here. We currently have a respect problem in the house that I would like solved. As stated in the lease agreement, point 40 has listed "There will be a $800 a month charge for each additional person residing in the apartment that has not signed the original lease." We have had one person staying here since June who has not been paying and now we have another person that has slept over this entire week without house agreement (we have an excel doc documenting these unapproved stay overs if needed) . These people also have our house combinations which is a violation of security (something that is taken very seriously with me). There are also issues with fridge space and these people ordering mail to our house. We have made numerous attempts to be as nice as possible and remind people of this agreement but I have seen no movement on the issue. It's only getting worse. When these issues are brought up in the groupchat or house meetings they are either ignored or mocked. If you could give advice on what to do that would be greatly appreciated. Have a good night.

The rooming house for students is just a perfect place to have the problems you have. Someone is paying rent and feels they should be able to have someone "stay over". The "guest" makes it difficult to end the stayover. So you have to step in and moderate. Maybe your moderation needs to be built into the lease. I just contacted a tenant in a duplex. The other side made comments about the laundry being done at 3am four days in a row. This wakes the people in the other side up.

Once I made the concern known the offending side agreed her son was doing it and it annoyed her as well. Now she has me involved so he will stop.

Cost me a little time but both sides are happy. I gained no extra monies for the trouble, but I have two sets of tenants still paying rents and both sides are happy.

Now if they do it again I will get all up in their business. If the girl brings in an additional roomie there will be trouble. That is the time to start dinging for money and lease breeches.

I see it as BillW rents the house for $XXX/mo no matter if there is one tenant or 15 tenants.

DJ, as Zero says, I rent to them as a group, so the rent amount does not change regardless of group size. I used to vary it but I don't think I can anymore due to rent control laws.

I disagree with the posters saying this was not your problem to get involved with. This was a lease violation and you addressed it. As for whether you received anything for it, you didn't receive any compensation, but I'm quite certain you received good will. Of the 14 original residents, you've likely got 13 who will either keep renting from you or recommend them to your friends. If you hadn't handled the situation, you could easily have 13 who would tell of of their friends not to rent from you because you wouldn't help them with a problem. --68.1.xxx.xx

College roommates is a huge learning experience.

When MY kids were sharing college apts I made a list of rules for all to sign - cuz *I* was paying their room and board. As teenagers they ignored my list.

As the rent payer I was PO'ed to discover they had been letting a guy sleep on the couch and bring his dog all semester. (the dog peed on the upholstered furniture!) My child did not see the harm because he was not paying the bills and was non-confrontational.

Tough to define and enforce GUEST rules. If the BF is there from 3pm to 2 am, eats with the res, lounges on the whole couch while watching the game (so the girl residents could not watch their Hallmark movies...)

No overnight guests. Go to THEIR apt.

No showering or laundry by guests.

Padsplit co makes it simple - no guests. Period.

My only suggestion is to encourage self-policing. Let them work it out themselves. Maybe anonymous voting.

Thank you Just Tim. I think you’re right about receiving good will by helping the group work out their differences. They are young and inexperienced at compromise. The landlords voice has weight and we’re far enough from the trees to see the forest.

BRAD, I’m not sure what you are suggesting. You said to let them work it out themselves, but you also listed some guest rules. Are you are saying my student groups should develop their own rules, and the landlord shouldn’t be writing them, but encourage the group to develop their own? I have seen things like chore charts and kitchen cleaning flow charts posted in some of the neatest student houses. Maybe I should pass out some chore chart templates during the lease signing? Maybe I should say things like “no overnight guests” in my lease. Thanks!

I think you handled it in a very respectful but authoritative way. I try to keep peace with my tenants if possible. I don't think it is so much about helping out the tenants. It is a lot more about not allowing your house to become a free flop house for druggies, users, and losers.

Bill I did read what you wrote and that you stepped in for this situation. I meant to be more clear in that you might want to manage this more on a weekly or monthly basis. I would make myself a presence there doing odd jobs or whatever. Doesn't seem right to make one person renting from you run it like he or she is the mayor. Weekly or biweekly meetings with YOU or maybe monthly. I would be posting notices maybe biweekly as reminders. But then I would never have something like this as I look like no one anyone would listen to. Needs a guy to run something like this easily. --173.61.xxx.xxx
