You need to first consult with your local police about steps you can take to secure and record these occurrences. File police reports and provide pictures.

I had kids skate boarding in a strip mall that I owned. When I saw these kids, I asked them kindly to please do not skate on this property because there are cars, parked and moving, and other people walking that they may accidentally collide with.

The kids ignored me, went into a market on the property and came out with their two parents. The parents asked me who I was and how dare I speak with minors. I told them I'm a contractor that worked for the owner and had permission to "police" unsafe events, such as their kids skating around cars, people and falling off their skate board and launching the board into a parked car.

I told the parents they their family is NOT allowed to skate here. The parents said they are NOT going to tell their kids to stop, if fact, they will encourage them to continue to skate.

Sometime later, around 3 weeks passed, and one of the kids was skating by a UPS Store in my mall, cars were parked in the fire no parking zone in front of the store and when a person walked between cars, the skater kid knocked into one of them, fell down, knocked a tooth out and damaged a BMW.

So the parents sued the Mall's LLC saying their kid was walking and got knocked down. This case went to a pre-trial hearing. The parents and kids lied. I was brought in as a witness.

The judge wanted to MALL to pay for the damage to the BMW, child skater's tooth AND punitive damages in the amount of $100,000.

So while on the stand I got to identify myself. I told the Judge I had spoken to the parents about their kids skating and how DANGEROUS it was. That the parents told their kids to continue and that I had no right speaking to minors.

The Judge wanted still for the mall to cover damages, plus. Then I told the Judge I had video footage of my conversation with the parents and the incident. The parents claimed they never spoke to to or anyone associated with the mall.

I showed the footage without audio. The judge said this doesn't prove anything. I then payed my cell phone audio recording and also the video again. It was no obvious they all were liars and the judge was bias. He was of the same country they were from.

I also let it be know I was "an" owner of this mall and I gave them all notice to stop. Also I had the owner of the BMW once ticked by a motorcycle cop for parking in a fire lane.

So I just wanted you to see that you need hidden video/audio cameras, put spikes on top of your fence and get a guard dog who will not bark, but bites first.

Please tell us how you managed to get around the CA law that states that

"A person who, intentionally and without the consent of all parties to a confidential communication, uses an electronic amplifying or recording device to eavesdrop upon or record the confidential communication, whether the communication is carried on among the parties in the presence of one another or by means of a telegraph, telephone, or other device, except a radio, shall be punished by [specified fine or imprisonment]"

That same law also states that "Except as proof in an action or prosecution for VIOLATION OF THIS SECTION, evidence obtained as a result of eavesdropping upon or recording a confidential communication in violation of this section is not admissible in any judicial, administrative, legislative, or other proceeding."

So, I'm really curious how you were able to bypass this seemingly obstruction to this matter of basic privacy in CA law.

The video was from the Mall's security camera's and of course there was no audio. When the kids came out of the store with their parents, I pulled my cellphone from my pocket and pushed record. I told the parents that the owner is on the other end of the phone and that "he" can hear you.

So the family knew their conversation was not privileged. And one market employee was standing nearby listening to how I operated. And others were within a close proximity hearing everything. --47.155.xx.xxx

Neighbor next to one of mine has been vandalizing my property in various ways for twenty plus years. He cut trees without permission and various other annoyances. I got him when he stole the survey stakes on the property line. All the judge did was give him community service and put a no contact order on both parties. He is still doing small things like cutting the landscaping bushes and throwing the debris on my property. He's very old and now has a young relative living there to continue the harrassment. You need a witness or video record and if he doesn't like his community service maybe he will stop. This guy had to be a sidewalk crossing guard. If I call the police about anything else he does, the judge calls him in and speaks to him. Younger one does the "duck walk" like a Na si, very scary. --173.61.xxx.xxx
