That we LLs in BLUE state/cities where the tenant's criminal and eviction history is expunged/sealed need no longer pay for background/eviction checks b/c it will turn up nothing anyway?

I read an article this morning and they have to stay out of trouble for 7 or 8 years for a felong to be expunged and 3 years for a misdemeneor to be expunged and does not apply to murder,sex crimes and a couple other things.Assuming they start the count t when they get out of jail do you think someone racking up felonies can stay out of trouble 7 years? Ken ... Interesting that you bring up the number of years of rental history. I just looked at mine and it doesn't ask for the number of years, it just provides the past three residences (which they typically have trouble completing anyway).
Do you (or anyone) have more than three spots on your applications for this or is that normal but you still ask for # of years back?
Mapleaf18 - I don't believe they have expunged the criminal history as of yet... at least, I haven't seen anything where they have (in NYS anyway). However, yes, I would still have the background checks pulled. --69.201.xx.xxx |

I've got a new tenant from California and the credit report came back that they can't do a criminal background for California, so in future, I won't pay for the criminal background if the applicant is from California. Do You think you will not be held accountable if someone that you didn't or even couldn't screen due to this law hurt someone else in one of your Multi-family places?
I think the ruling will be - the land lord could have or should have known about the tenants past. So this makes for a catch 22 for all landlords. I am sure though, there isn't a single attorney in NY that will think ANY LL has any cash (No sarcasm there - yeah right). Back in 1989 I had a mother try to rent a 3 bedroom House with a son who was over 18 and a convicted sex offender. The son's criminal record was not available to credit and background checking firms. But I learned of this issue so I denied tenancy. I was back stabbed by the L.A. City Counsel, the City Attorney, Housing, etc. Saying I was discriminating.
I told the board to call the police and they will tell City officials that the son of the person looking to rent my house isn't choosy. He rapes little boys, girls and animals too. --47.155.xx.xxx |
