In an area of smaller apartment buildings, limited by lot size and height restrictions things pretty much go okay. That's until pot head moved in next door in Los Angeles, CA where pot is legal. All of my 10 tenants can't leave their windows open due to the pot smoke making it's way in our direction.

Taking to the tenants, owners, property mangers and the police have yielded zero results. So I had to put a plan into action.

I had delivered three cargo shipping containers. A 40 foot and two 20 foot. I had the two smaller ones stacked on top of the longer one, thus building a 16 foot tall and 40 foot long barricade.

It doesn't stop there. I have intake fans, ducts and a return system that blows the pot smoke into the owners unit, managers unit and a hot head security guard who lives next door and carries a guy.

They cut my power line to the containers, but it doesn't matter. I have a 24 volt 10,000 am Solar battery inside that can power these fans for days.

That owner called a friend who know a police captain who's stationed nearby. When the police showed up a few days ago, I used some choice words (French) for get lost. They can't selectively enforce laws for some and not others.

I then sent the police night commander a cellphone video of the pot head tenants supply pot to minors..... Let's see what's going to happen next. --47.155.xx.xxx

Nice job! Similar happened at one of mine. Smoking out the window of duplex next door going into mine. Downstairs tenant went after them with town and also calling absentee owner of building who lives forty minutes away. On humid days skunky smoke filled the big back yard. She is a pit bull and the neighbors had pit bulls with four legs that threw themselves against my fence and caused damage. I had it reinforced which cost several hundred dollars. No gate on their side. LL won't pay for one and the tenants were supposed to because of the dogs but they didn't. Animal control came numerous times. Pits are still there but the tennies bought their own fenced in small area to put the dogs in when they are not in the basement. Neighbors are watching out for the welfare of the dogs in hot weather. NE- we once got a 2AM phone call from a T in our multi about "someone smoking pot". SO insisted on going over. I still don't know why. I kept saying "and what are we going t o do?". SO finally realized that they all accused each other of things-spouses included. Told the one who called to call the police next time. Nothing we can do. I am not a drug sniffing person or animal to tell where it came from and what do you want me to do? I don't know if it is from one of them or the house next store. Don't bother me with it. My properties are in Culver City, where the liberal City Council passed a very strong anti-smoking ordinance. It includes application to pot smoking and essentially forbids smoking anything, anywhere in Culver City, including in the smoker's own home.

My personal home has 7 homes along my various property boundaries. One tenant, a family with kids have BBQ's every week and the smoke comes my way. I've tried taking to that guy but he is from another country that no one can tell him what to do. So my A/C bill is an extra few hundred a month because of him.

Another guy, older, lives by himself in his estate, had parties with a live music band, smoked food etc. In his case I've warned him to stop the 100+ dba music by 10pm. After that I cut his electrical feed an then his party is over.

Two more families tell me they are having a party for their kids and stop the noise by 9pm..

I live in an HOA of mostly senior citizens. Occasionally on our evening walks we catch a whiff of the skunk weed. There's one old guy down the block who's fighting cancer and had a stroke. He and his other 75 year old buddies from our hood hang out in his garage and puff a little and watch TV. I've softened my opinion over the years. If he/they want to smoke a little legal mary jane, they've earned it.

It's better than the guy who smokes big stogie cigars on his patio and stinks up the hood for 300 feet. I think he heard me coughing and btching awhile ago walking by cause I haven't smelled 'em lately.

We went to Telluride during the Mushroom Festival a couple weeks ago. We smelled some of the devils weed wafting through the air a couple of times. But hey, it's Telluride!

As for BBQ - there should be a law, enforced by confiscation that if you are going to BBQ you need to make enough for everyone downwind. It is truly cruel to not share. ;) --47.216.xx.xxx

Our neighbors on both side of us; one smokes skunk weed, the other cigars. Neighbor across the street burns his foul smelling garbage, and the one behind and on one side of us has firepits going. Never mind the trees that hang right above their firepits and there are dry, no fire warnings issued for the area.

I've not mentioned anything to the neighbors since the last one who moved to Texas trashed every inch of the car I owned then, even though I was kind in my ask that his kids not play kickball in the street in front of our house, knocking off my side mirror 3X.

Hubby asks the neighbors we are friends with to let us know when they are having fires ahead of time so we can shut the windows and use the A/C. He let the neighbors know I am disabled by smoke (truth) from my years working in it where I had to take my employer to court and won my case years ago. Still, one next to us was so unkind with the request coming from him, knowing my asthma, etc. I'm done with them; hubby can be friends. Any burning they do on their property is illegal per our City rules as their house and lot are not large enough to burn a fire on it. But, hey, we are not reporting them. Just trying to peacefully exist.

Smoke, including second-hand smoke is unhealthy and people who don't smoke need to be protected as a health hazard.

Someone asked, who enforces this, Police?

Actually, as usual, innovative ideas come from CA.

The law allows private Civil actions to enforce the anti-smoking ordinance.

and actually, smoking has been pretty well eliminated in CA. Everyone recognizes the health risks of smoking, and I rarely see anyone light up, where permitted or not. No one seems to smoke, here.

I agree with you David, I love freedom just as much! Thatís why I only care about these rules when they apply to me. And for my benefit. For example, no smoking in my rental properties, because it damages my investment. I donít care if you smoke in your own home. And as far as smoking out the neighbors, Iím 100% guilty of that. I have collected somewhere around 10 to 15 ELTs, (thanks Brad). I have one tenant move out . Because I screen aggressively and require high credit score.

And of course, one can evict based on lease violations.

I can evict tenants for non payment and for lease violations, just as easily or easier than you can evict for 30days notice on m2m

In 2018 I increased my credit score requirement to 720 and a lot of people laughed at me, said it was ridiculous. Well it wasn't so funny when all my tenants were still paying rent thruout 2020.

A lot of landlords use eviction and M2M as a backstop and crutch to poor screening. They think it's not a big deal if a marginal tenants gets in, because they can evict.

All tenants are potentially bad, that is true. But M2M won't save you, if the government stops allowing eviction for non payment of rent , they can do the same for no cause eviction --68.56.xxx.xx

My concern then was not being able to evict because someone cries C-19. If I have to go to court to evict a tenant for staying past the end of the lease, when the lease is over and our contract is done, that is different than trying to evict a tenant is not paying because theyíre claiming C-19 and thereís a government moratorium on evicting backing them up. Huge huge huge difference. Not even comparable.

David, I think you mustíve missed the majority of Convid eviction moratorium discussions on here. During all that, a no cause eviction with a MTM lease was an absolute winner, because you could just end the tenancy. Except for the woke liberal jurisdictions where common sense and no cause eviction has been outlawed.

However, going forward, if they state ďno evictions at allĒ during the duration of whatever manufactured crisis they cook up, then weíre all in brand new operating territory again. Like we ALL were with c-19. At that point, existing rules have been suspended and weíre no longer operating in a civil society, with the previous understood precedents.

With another property, a SFR, I put a cargo container like the ones I used at my apartment complex, in the back yard more than 5 feet from the boundary line. It was sitting on a cement pad, not bolted to the ground. It is called Temporary Storage.

After 30 days the City of Los Angeles said, If I don't move the Commercial Cargo Container off my rental, I would be fined $1,000 per month.

I went to a hearing and if I only pulled a temporary permit, good for 2 years, this wouldn't be an issue. Then I said to the hearing officer, "Are you going after everyone with out a permit storing a cargo container on a residential property" The hearing officer said yes.

I called a tenant who's day has a helicopter business and he arranged for a photographer and we flew over my rental and everywhere within 1 mile.

When the City took me to court because I refused to pay the fine or move my container, I told this real judge this was selective enforcement. If I could prove it the judge would dismiss this case. I gave him a list of 50 people within 1 mile of the rental who all had cargo containers on their properties, without a permit.

Judges, City Employee, A Supervisor, etc. Many were attorney's. I took one of the letters the City sent me to remove the container and copied it with the other home owners. The City had 50 angry owners go after them too. --47.155.xx.xxx
