State Specific Question About: GEORGIA (GA)

Is it legal (in Georgia, or anywhere) for a landlord to demand, or just accept, if the tenant offers, up to six months' rent up front?

I thought that it is illegal to collect multiple months of rent up front, (plus I think it is bad practice since anything could go wrong on either side)

Personally, if I am not sure about a tenant, I would double the security deposit, which is typically a bit more than one month's rent.

Two people have recently offered to pay or requested to collect six months' up front, and I said that is not legal. I have no idea if this is addressed in Landlord-Tenant codes.

Anyone actually KNOW the rules surrounding this? thanks

I am in Indiana.

I once collected an entire year's rent up front. The tenants got money from a settlement and knew they would blow thru it.

Unfortunately I got rid of them a couple months in because they were bad tenants. I refunded what was not used.

It sucked giving it back but would have sucked more keeping them.

I can't imagine it being illegal to collect the money up front. You collect the rents up front a month at a time anyhow.

They were able to save up a good nest egg not paying their rent during the pandemic. There’s nothing wrong with getting paid upfront, but only if they pass screening with flying colors. Deadbeats love throwing the promise of money around. --71.63.xx.xx

Most leases contain clauses that the lease is for a specific term. Rent is due in full for the full amount in advance.

For the convenience of tenant this may be paid in monthly

Installments.

Most LLs prefer to collect monthly as most judges will hold that if the T has paid rent, it’s very hard for LL to evict a problem tenant during the lease term. --67.21.xx.xx
