NEW YORK – State lawmakers in New York are moving forward to approve the controversial “Clean Slate” legislation. The new law will seal criminal records for the overwhelming majority of crimes once convicted criminals serve their time, which is already being reduced in so many cases. The law will cover misdemeanors and felonies.

Critics take aim at “Clean Slate” as helping convicted criminals at the expense of their victims and public safety at large, while supporters of the proposal claim it will boost the labor pool while giving people a second chance years after they have served their time, the New York Post reported.

Could a NY applicant still be asked for their most recent 2 (verifiable) landlords? If they can't tell you where they have been living for the past several years, then rejection is automatic anyway. You don't need to know their criminal history. --107.141.xx.xxx

To clarify some things...

Misdemeanor records would seal after 3 years. And Felonies after 6 years. So, it isn't as short as "served their time" (since there is often no time served for misdemeanors).

Also, sex-related offenses are exempt and would not be sealed.

I can see some logic in this, but other places that have done similar things actually found that it does the opposite: it often INCREASES discrimination. Because now, if anyone applies that has a gap in their history, people ASSUME it was a horrible crime as opposed to just something more minor. That sort of thing.

This is likely to backfire.

John,that is how all these policies wind up,they all back fire on what was intended. i used to take a chance with a low end tenant because i could get them out quickly,now they are making it difficult to evict so i dont buy low end units to keep now and a tenant has to be perfect or i will keep looking --74.77.xx.xx

The aspect of this law that I find troublesome is that people convicted of financial crimes can go back into the finance Field since their records are sealed. I would never trust that, that person won't try to rip people off again. --172.59.xxx.xx

Small potatoes: That simply isn't the case. This law specifically gives governments, police, and so on access to all of the records. They are not sealed from anyone doing licensing, for example. So, no, people convicted of financial fraud cannot just go back to what they were doing because the records were "sealed." --67.209.xxx.xx

Again, I don't agree with this. I was just responding to Small potatoes' statement about financial fraud people being able to go back because of this. That just isn't how this works.

You can be against something and still want the information to be accurate... Misinformation is bad -- regardless of if it happens to fit the narrative that we support.

Seems like these Socialistic states are heading in a direction wherein a landlord with a vacancy will have to send a request for a tenant to the gov't and they will decide who we rent to.

I guess if a guy served time for burning down his apt. bldg., or maybe he beat up his last three neighbors, I am not supposed to discriminate against him? --73.141.xxx.xxx

Question for the group -

If someone has a Misdemeanor and then is squeaky clean, how long would you hold that against the person and tell them No?

If it were just one event, three years might be a good number.

What about Felonies? For me, I use 10 years of being squeaky clean - but it would be depend if there was an act of violence or not.

If these records are sealed, I guess there should be less fair housing complaints and LLs can't be held accountable for tenant actions. --24.101.xxx.xxx

For me I will not allow anyone with a DV or sex abuse case.

Years back I talked with a guy and his wife. He had a sex case but assured me it was not against a little kid. Was a person who lied about their age. I took them on. The tenants around them found his info, which was tougher back then, and raised a fit. All they could see was that he was on the list.

Turned out he was a terrible tenant anyhow and I booted them.

Sad thing is that people get wrongfully convicted of crimes like that and DV all the time. But I am not a lawyer or a judge. I can't decide if they did it or not. I can only decide on what the courts said.

That being said tho I have and will take people with other problem pasts on a case by case basis. Have a tenant of 8+ years that had a DUI 20 years ago. Squeeky clean since... although maybe a little too loud for my liking, but meh... that happens. --107.147.xx.xxx

I had a long term tenant who plead to a sex case. Accusation of a solicitation to a minor, who was a friend of his daughter that had had a falling out. In my opinion, he was guilty mainly of putting himself in a situation where he could easily be accused and not being able to afford a decent lawyer to put on a proper defense and so plead. I let him stay. He was married with a child. --73.141.xxx.xxx
