I want to op out of one of my tenants auto renew of their lease agreement. under sect 8. I left a message to that effect with the local office. Seems like I can't find anyone ever there. Is there something else I must do, like send a cert letter stating the same? --66.30.xx.xxx

Most S* contracts call for 60 days notice. Make sure you send the notice to terminate the existing lease at least 60 days before it's due to renew. Send the notice to both the tenants & their case worker. FYI if the tenant decides to stay past the end date, the PHA will stop paying their portion of the rent & you will have to evict the tenants. --72.93.xxx.xx

Just raise the rent a couple hundred bucks 60 days in advance. They will reject the increase terminating the renewal.

I have a portal. Online. Where I can read this type of information. In my area it is more like a 90days from renewal date. But ever office is different. Ours renew every two years but there is a process for in-between. --172.59.xxx.xxx

In our area for S8, after 1 year you can raise the rent to 'anything mutually agreeable' - of course the tenant is responsible for anything above the FMR for the bedroom count of their voucher.

So raising the rent a bunch may not terminate the renewal, it may depend on the rules of your area's S8 adminstrator.

If the tenants understand that their not paying means you report them to S8 and their voucher could be in danger, they tend to work with you (not against you) to find a new place. Of course there are always exceptions! --104.255.xx.xxx

There are a number of problems with this tenant, but one is her grown daughter moved out and left her kid there. The kid is not well behaved as well, and causing other tenants problems.

That daughter moved in with another boyfriend (not the first time) and once in a while visits the kid,..I was wondering that if she was given this very large apt because sect 8 thinks that its being occupied by three people inside of one adult and a child would that disqualifty her from staying at this unit?

If you raise the rent to a level that Sec8 won't allow, they will terminate the agreement, but I guarantee you that that tenant won't leave. You'll have to evict to get rid of them. Therefore, I don't think I'd bother with the rent increase method.

Unless your state doesn't allow it, simply terminate the lease without cause. Give proper notice and make sure the tenant is very clear of the date that they must be out.

I don't see a reason to play games jacking the rent just to get Sec8 to say they won't pay it. If you want to terminate the lease, then terminate the lease.
