I have a couple moving in and want to know if it is better to make one agreement with both names or 2 different agreements? I have always made 2 agreements but recently I had a situation where one left and the other still wanted to stay. I made a new agreement for her but she eventually failed and now being evicted. what did I do wrong? --73.117.xx.xxx

Not sure you didn't anything wrong. People who rent, rent for a reason. Ask what you can do better! I'd put them on one lease, both as equal signers. Interesting that you made two agreements, was this a roommate situation where each paid and rented a different amount or area of the property? --172.59.xxx.xx

PAM, I'm at the end of ridding myself of the last of 3 that I signed different agreements with. Make the same lease with both, and "joint and severally" responsible for everything.

Previously doing separate leases with everyone worked for years and years, until it didn't. --75.11.xx.xx

I agree with making them jointly and severally liable.

If they are "a couple", it sounds like they are more than roommates, but a single household.

Did you need to count all of their income together to qualify them? You will want all of that income available if something should go wrong.

If they can unlock 1 door there should be 1 rental agreement, when you rent a 4 door car how many agreements do you sign? No rocket science here, you must bring back 3 more doors to the enterpriserental office - the same color. or it gets costly quickly. --184.59.xxx.xx

Same here as with others... one lease/agreement with both parties on (and make sure you have the jointly/severally clause). I actually explain it to them as well as we review the lease at signing.

I don't care WHO pays what... if the two of you want to split the rent, that's fine... but if I only receive half of it I am not interested in WHO paid WHAT... all I know is that I don't have the full amount and I will go after BOTH for the full amount... not just one person. --69.201.xx.xxx

You can't make 2 separate agreements to rent the same property to two different people. Both of your agreements would be unenforceable.

Concur with Moshe. What prevents either one of them from trying to get utility assistance as the only occupant of the house. Guess what happens - you accidently made yourself part of welfare fraud case....and maybe not even know it. --24.101.xxx.xxx
