So Ms. Excuses who has now turned into Ms. Tenants Rights has made it clear that all legal notifications from me per New York State laws is "harassment."
I gently reminded her today that her keys are to be returned and forwarding address left in order to get a returned key receipt and any sec dep that might be coming her way.
I was met with a barrage of screen shots of tenants rights and that any contact by me is considered "harassment." Also that she will not be out completely until 6/11. I have offered her an exit inspection at least twice before and received "crickets."
So I've contacted my attorney to start holdover eviction proceedings. She also stated that her "attorney" has advised her that me contacting her (for pest control appt notification, etc) is "harassment." I asked for her attorney's name and was met with NOYB which to me means she obviously doesn't have one.
Are holdovers/evictees entitled to a move out inspection since her silence on the matter to me indicates she's refusing one? --64.246.xxx.xx |

P.S. she never returned the entrance inspection paperwork--claims she "misplaced" it. Lesson learned, will never let any paperwork go to the tenant without having copy in hand. I now have a mobile office setup so I can return copies right away.

How frustrating! Sorry you are going thru this, glad you are on top of this and have a plan, carry on, follow thru by contacting your attorney. That is the right thing to do. ianal, in NY state any tenant who gives at least 2 weeks' notice is entitled to a pre-move-out inspection - but if you offer and they don't respond, your obligation would be fulfilled (as long as you can prove that you offered). --104.255.xx.xxx |

Ken, I think it is ridiculous as well. Ripe for a landlord to get rolled.

Inspect the Rental Unit
Landlords must offer tenants the right to a pre-move out inspection, which should happen no sooner than one week before the tenant leaves, nor later than two weeks before. At the inspection, you should look for issues for which you'd deduct and inform the tenant, who will then have a chance to correct them. After the tenant leaves, you will need to inspect the rental unit to assess what cleaning and damage repair is necessary. Many landlords do this on their own and simply send the tenant an itemized statement with any remaining balance of the deposit. If at all possible, do your inspection with the tenant who's moving out, rather than by yourself. This will go a long way towards minimizing deposit disputes. Ideally, you will have used some kind of inventory or Landlord-Tenant Checklist when the tenant moved in so you can compare the condition of the rental at the start and end of the tenancy.

Had a eviction drag out for a year where she claimed she was harasses for rent where photo graphed every text sent and received to her. She put a stay on the sheriffs order. Where had the order lifted then out the door. From that point on a minimum credit score of 700 and above or they keep looking. They act like they own the complex where they are renting a space. A sheriffs order is harassment for rent when you ended the tenancy. Non payment of rent there is no longer a tenancy. --74.220.xxx.xxx |

6x6, thx. no pain really. Just picked up the phone and called my attny. Emailed him all the paperwork.
One down, one to go (jettisoning my uncooperative, wanna-make-our-own-rules tenants)
What I've learned:
1. no renting to someone without a vehicle
2. no renting to anyone who wants an exception; on this one I had a gut feeling but I ignored it. She wanted a printed prequal/application b/c she "didn't have a computer" umm you can do it on your PHONE. Almost everyone has a smartphone these days.
3. never be in a hurry to rent a unit out. I was kind of feeling the pressure b/c the love birds who were breaking up were moving out of the upstairs unit at the time (also no non established couples who want to play house for the first time in my unit other than non platonic).
