selling with partner (by ed [MA]) Posted on: May 22, 2023 2:10 PM Message:
Both my wife and I have been hit by illness she is out of state due to her treatments.
Neither of us can travel and its time to sell as I can no longer handle things,
But she was put on the properties several years ago as I thought I would probably go first.
Is there a way to sell these with her being away? --96.236.xxx.xx |

It might vary by state but I'd look into power of attorney. Also, I'd check with a local elder law attorney as to details on your thoughts and how best to do what you need to do.
I hope your wife gets better and you achieve your goals. --172.58.xxx.xxx |

How was the deed prepared? Jointly with the right of survivorship or as a TIC?
If it is a TIC, YOU are selling only 1/2 of the transaction. If it was done jointly you will need a POA, which might get tricky depending on your wife's mind. Either way, you should lawyer up now. --24.101.xxx.xxx |

The docs can be prepared and sent to her, hospital has a notary or you can find a mobile notart in the area or you can take them to her for her signature --74.77.xx.xx |

It’s not uncommon for a seller to be remote when selling a property. A lawyer can draw up the appropriate forms for her signature and then she will not need to be present. --107.77.xxx.xxx |

The docs can be mailed to her and she signs in front of a notary, or, she can sign a POA in front of a notary ahead of time and you attend closing for both of you. Best bet is to get the POA from the buyer's title company since they are the ones that will decide if it is acceptable. --73.141.xxx.xxx |

If you are selling them yourself, get a lawyer. If you are hiring a broker, you probably do not need one, at least to handle the transaction. An experienced broker will have handled many sales like yours. --73.141.xxx.xxx |
