Ms. Excuses texted me today saying she found a place but it won't be ready until July1st. I'm ending her M2M end of this month. She received proper nofication that we are not renewing per NYS 2019 laws.

And I quote: "I found a place but its not gonna be ready for me to move in until the end of June. Since I'm not technically being evicted can I stay until then? I will pay June's rent."

What bothers me is that "Good Cause" is looming in the NYS legislature right now and could be pronounced and signed into law retroactively to the state budget date of April 1st which means I can't just end the M2M with her.

why are you doing that? she's on M2M. Just ask for formal notice-- "I'm giving notice to vacate June 30. Please accept this as my notice".

I will be sending in my June payment prior to June 1, 2023.

Not to sure about the control issue but this note puts YOU in control in a business sense.

MOST of my rental properties are in Los Angeles, California. This town will put me in handcuffs and ship me off to jail on the word of an illegal squatter over a 45 year long term licensed landlord. So I know what it feels like to be helpless.

BUT IN YOUR CASE here's what would I do.

I would not show up at the property or speak with your tenants. Everything is thru emails and text messages.

I would have received a written letter from my current tenant stating when they would be out, like Wednesday May 31st, 2023 by midnight.

Then I'd pay another party to drop off their furniture in Pod's or Shipping Container on the property. So when my current tenant says I have not moved out yet, you tell them until they are gone, they are now sharing the house with the new tenants, must pay rent and pay for the extra storage of the new tenants belongings.

Then my marry cast of charters will show up and start living in the property. TWO CAN PLAY AT THIS GAME! --47.147.xxx.xxx

Thank you for sharing your rejection of your newish tenant, noting that she will be out by 5/31. Her borderline behavior as described in your many posts, including the one titled, "Unreal," shows her duplicity of asking nicely to stay another month. I agree with Jason about her controlling nature. I myself had a similar tenant and did the same as you.

She likes to make her own rules.

1. She moves family members in that aren't on the lease then accuses the upstairs unit of doing so (no evidence of this).

2. She failed to return the entrance inspection paperowrk and her pet paperwork (the dog ate it, her teenage daughter threw it out while "cleaning" and on and on.)

3. She parks wherever she feels like it

4. She forgot to put out the garbage receptacle then blamed the trash disposal people for not picking it up.

5. She lets others (friends/family/deliver people) park wherever they feel like it.

6. She reported a serious issue almost a week late that could have flooded out the unit and done damage (old sewer line issues that we were unaware of but corrected--this was the first year the bldg was put into service after being abandoned for over 10 yrs)

7. She complained about neighbor noise; yet no other neighbors can verify this. I told her how to deal with it and she refused to follow the procedure saying "I should just take her word for it."

8. She paid rent late in March and blamed the post office

9. She paid rent late in April and blamed some back injury 8 weeks earlier and short term disability (no mention of this being out of work back in March nor any other convos)

10. She complained about her utility bill. Umm utility bills have skyrocketed over the last 2 years. for everyone.

11. When I told her I don't appreciate her making her own rules she called us "slumlords." Umm this is a BRAND NEW REHABBED UNIT--new EVERYTHING!

12. She complained about a yellow jacket getting into the unit.

I could go on...

I don't know you but this LIST is nothing experienced LL's don't have to deal with. Many instances we ALLOW ourselves to be manipulated this way. Step back and re-eval what you did -- right and wrong-- honestly.

When I examined this LIST I laughed somewhat because we see this kind of stuff daily. I looked at each item and recognized it as one of my tenants. Not all the items for one tenant mind you but on a monthly basis it regular stuff. Putting up with it has made me and my family a million.

MYOB, again all this happened within first 6 months of tenancy.

Plus I forgot to mention I recently received a call from the upstairs (good) tenants to say that her (son's) car was blocking the entire mouth of the driveway (she did this on purpose) preventing the upstairs tenant from parking in their designated spot. I'm convinced she did this b/c she knows we are not renewing.

I wholeheartedly disagree with you that I'm in the wrong biz. I used to do this back in the 90s only in D class. This is a C class with pockets of B.

I only have 4 active units going. Yes you would deal with this on a daily basis IF you had a large number of doors (much more than 4)

The only red flags this woman exhibited before selecting her is that she was unable to do the google forms via the normal manner and wanted the application emailed to her instead.

Which, to me, is now another red flag. Also she doesn't have a vehicle of her own for some odd reason but has plenty of adult children that do (and block the driveway) --64.246.xxx.xx

Sometimes we just have to accept that we can't just physically can't them out. We can push all the paper and follow all the rules, ask for corroboration but at the end of the day sometimes you just have to roll with it. I would ask if she would kindly share the LL's information so you can verify the actual moving dates or maybe she will sign an agreement that the agreement is ending or maybe you just have to file for eviction and let the Court do their process. Once trust has been broken, it's very difficult for me to work with someone. I would not trust her to pay the June rent nor to be out on time. Now that vacancy rates are really low tenants find they have pay a much higher rent than where they are living. So that is not your problem as immigration is reducing the supply of all types of housing. Damages done by tenants drives up the cost of rent. --68.69.xxx.xxx

UPDATE: I did not hear back from her after denying her request (no surprise there)

But as I was doing some lawn work shortly after noon yesterday I noticed what seemed to be her grown son? staying there and walking her dogs. He looked kind of old to be her son though so it might have been her boyfriend. I asked him to move his car (parked on the lawn) so that I could mow which he gladly did. I have his plate number btw and an easy way to run his plate via old connections. --64.246.xxx.xx

AGAIN mapleleaf18 re-read your 12 issues posted above-- please post more because I for one WANT OUT OF YOUR PLACE! This post when dissected is truly what's wrong in LL'ing with owners.

I particularly like the blamed post office. This past month our tenant said i paid the rent Apr 29 and it was mailed at your post office. She issued another payment that included 8 days late on May 9. May 11 we got her payment-- money orders purchased Apr 29 cancel stamp Apr 29. our mailbox is 10 ft away from clerks desk. Yellow jacket-- call the housing authority and get sited for all those ripped screens and air gaps on your structure. Oh! and the "she didn't put out her trash can out" now there's a huge violation of what I don't know? Don't know about you but my wife gets aggravated whenever I forget. My mortgage company doesn't care. (ditto my neighbors)
