A state Appellate Court has struck down the “good cause eviction” law implemented by the city of Albany earlier this month. The ruling effectively ends the conversation on a local level unless the state’s highest court, the Court of Appeals, decides to hear the city of Albany’s appeal.
The “good cause eviction” policy requires property owners to provide a cause for an eviction and limits the amount they can raise rent on tenants. Albany was the first city to implement the policy, which includes a 5% cap on rent increases with exceptions for renovations and higher rises in the consumer price index.
The law was struck down by an Appellate Court judge who ruled that the city does not have the authority to change the relationship between tenants and property owners, adding that power lies with the state. The ruling effectively preempts the city’s law.
The “good cause” eviction bill, sponsored by Sen. Julia Salazar and Assemblymember Pam Hunter, has not passed either chamber and sits in the Senate Judiciary and Assembly Housing committees.

Expriopation never ends where the objective is to bankrupt then take over all the private sector rentals. Here they have fight with some cities that want to license private sector rentals which is cssh grab where every few years the landlords association fights.. Fortunately there are landlords associations. Any extra cost is passed on tenants as more government intervention drives up rent. In the province of Alberta there is no rent control where the leftist Acorn are proposing rent control where they ask the unions to agree to wage and price controls. Now therre are building new rentals along with converting existing structures into rentals with government incenties. Last year the population expanded by a million more people where new housing of all types has to be built. Socialism sounds good in theory where in reality less housing drives up rent along things are difficult for tenants. A proposal to help tenants is a solution. No matter who owns housing it is expensive to maintain and build. One industry can not made responsible for those with low incomes. Governments here have not done well in owning rental buildiings where those costs are passed onto the tax payer. In reality there is not enough money in the provincial, state or municipal or federal treasury to buy out all the private sector rental housing to become non profit. --68.69.xxx.xxx |
