In Ma to have a tenant as a Month to month,..in just about every other state you can just give notice of not to renew and give them a month or two to move.Here it seems that you have to evict them if they want to stay,..and go to court to do it.Now they are talking about extending the no eviction because of COVID for another year! --66.30.xx.xxx

Not defending your tenant protection laws, but in every state if the tenant refuses to move after getting a notice, we have to take them to court and evict them. There is no place where you can bring in a crew of big burly bikers and physically throw them out if they don't cooperate and go after they receive their notice. --76.178.xxx.xxx

The point I'm getting from george's post is not that he can't physically throw them out the day after the lease ends, but rather that if he wants to give 30 days notice, by default, the tenant can demand, "Give me a good cause or I'm ignoring this notice."

There's a world of difference between the legal write to end a M2M rental agreement for "just cause" and "just because." I favor "just because" because:

1) It's my property.

2) It's my property, and

3) .... It's my property.

The kind of residency that cannot be terminated for any reason or no reason is called "ownership." Don't want to have to move at the LL's discretion? Buy a house!

Sadly, george, you're in a liberal state, and worse is looks like it's only getting more liberal year after year. Expect more laws limiting your rights and income in the coming years. I recommend considering reallocating your investment dollars in states that support private property rights.

The last tenant I had to evict was given notice that I would not be renewing her MTM. I tried to work with her, but she decided to get tough on me. Said she wasn't going to move.

I filed on her the next morning. Here they get 30 days from when you file. I didn't need a reason. Thing is she stopped paying rent because of it so there was the top tier reason. --107.147.xx.xxx

Yes it would be and was. But I don't need it in my state, or at least not in my county.

I can just say I no longer want to rent to her and the judge grants it. That's the way it should be. As Sid mentioned... it's my property.

Possession is 9/10's of the law in MA ... I have always had to evict when I wanted the unit back. The lease or no-lease is useless and will often only get the LL in trouble (violating state laws regarding: late fees, pet fees, security deposit .... blah, blah, blah).

If you're LUCKY they stop paying rent (pre COVID). Non-payment evictions work well (pre COVID). --198.168.xx.xxx
