This is a follow up I had a tenant that filed a discrimination complaint for discriminating against him due to his two ESA animals. My attorney and I responded to all of their BS questions and now over a month later they want a 45 minute interview. The case is total BS, and i provided more than enough evidence that the animals were a nuisance. My attorney previously advised that we will not answer any more questions, I am tempted to tell them to pound sand and sue me if they think they have a case What say the group? --73.41.xx.xxx

Exactly WHO wants this interview? Just the tenant and his attorney? Absolutely pound sand.

If you mean a sort of mediator or representative from a government entity that is looking into the issue, then I might consider it with my lawyer present. Maybe.

Let the atty do ALLLLLL the talking.

This is soooo obvious they are trying to trap you.

One teensy weensy slip, just a word or two, or a glance and they will prosecute.

They are KING and crave POWER. They do not tolerate the least bit of attitude or non-compliance.

They can tie you up for YEARS and THOUSAND$$$ in atty fees then more in fines.

Take the high road and appear VERY cooperative.

Does your atty know that they are asking for this 45 minute interview and that was their response or did the atty state "no more discussion" and now they want to interview for 45 mins?

Either way I would highly suggest you follow your atty advise and not ours... we are not lawyers... I'm a fighter but I'm certainly no fool and if I was seeking guidance from an atty I wouldn't ask anyone else's opinion. If you don't trust your atty then get another atty that you do trust.

It may be that the atty is fully aware of what they are trying to do and is thinking "take us to court if you have something... otherwise move on". They are most likely thinking "if I can just catch them on one little thing... we got 'em". --69.201.xx.xxx

I hate living in an environment where we are presumed guilty, even though we've done nothing to cause any complaints. To me, this is Govt overreach.

Am I suggesting it's okay to illegally discriminate? No, not in the least. But it's not promoting a healthy, inclusive environment when people to try to trap you for one wrong gesture or "tone" they don't like... that's no different than entrapment in my mind: setting you up into a situation that has many nuances and trying to make you fail on record.

It's no wonder everyone is constantly suspicious and unwilling to utter a syllable without first consulting a lawyer. And my guess is the lawyers had a hand in making it this way to ensure they have perpetual job security at a high price.

Anyway, good luck with this! I agree with the other to button your lip and only respond when your attorney tells you to. The best advice I've ever heard is that staying silent is your right: use it.

Thank you for following up on your post about the hopefully soon-to-be-gone-"ESA" tenant. I understand your temptation to go against your attorney's advice to not speak further with the State division of Fair Housing investigators/litigators.

I personally would not grant the forty-five minute interview and not say a word to the investigators. As jonny NY noted, your hired your attorney to engage with the tenant's legal representatives with the purpose/goal of winning your case and having the tenant evicted. If you tell the investigators information, you go outside that representational agreement. Can you ask your lawyer questions without being charged fees on the reasons why you can talk directly to the investigators? It sounds like you are unhappy with the advice you were given.

I hope that the State Division of Fair Housing will justly find you innocent. The interrogators are assessing the case and might have offered you a forty-five minute interview as a procedural formality. They might have done the same for the ex-tenant. Thanks everybody for the support. After nearly 30 years doing this cra?*& I'm ready to hang it up. It's just not worth the stress anymore. These people are nothing but filthy parasites, sucking the blood out of the hardworking people. Like a Tick on society. I've had my fill of all the abuse, from the incompetent Cops that will tell you it's a civil matter, but when the tenant makes the allegations the cops are ready to put you in bracelets. Then the power tripping code enforcers, the corrupt politicians that will bankrupt the state without a care in the world so long as they keep their money and power. CA is a lost cause at this point.
