I didn’t think the video was very interesting earlier this week when it was first posted. It was just a single lady and her child squatting and the owner just bullying them. Had the squatter had mail-intent, this story would have ended much differently. --50.219.xxx.xxx |

There was already a thread about this video. I am not a fan of the video. I skimmed through it, but it seems that the people were just storing their stuff there rather than living there. Big difference. In Philly, try to throw out someone who can show by the slightest evidence that they have been living there even for a few weeks, and the cops will arrest you. --73.141.xxx.xxx |

Yes, it was already posted and discussed.
Did you guys watch the same video I did? Maybe you didn't watch the whole thing?
There were many people clearly living there. Several cars, power on, lights at night, neighbor reports.
Their (bad) intent was to live for free, aka steal from the owner.
I didn't pick up on him breaking laws - please explain which ones you think were broken.
He established that he had legal possession, entered & set up a security system.
When the woman and granddaughter arrived, he did not bully or treat them disrespectfully. Actually, many would have a hard time not speaking more harshly.
I think his key problem was going alone & potentially putting himself in danger.
Why he bragged to the Sheriff - who knows. I suppose in the hope that the Sheriff might take a different approach in the future? --68.229.xxx.xxx |

There were some good points from the video, however agreed that it was a relatively easy cake walk. Squatters could have changed the locks, been much more beligerent, violent, etc.

The guy gave the squatter a deadline to remove her stuff, or he would put it in the driveway. Some judges would consider that a self-help eviction. Squatters have rights. However, when she lied to the owner and said she was not living there, just storing her possessions, she waived those rights. Too bad all squatters aren't this easy to get rid of. --107.141.xx.xxx |

Do what you gotta do, but for PETE's SAKE, don't go telling the LEOs.
Here's the key part to me: "It's a civil matter."
Okay, so why can't a squatter squat on a squatter? Wouldn't the same process have to be followed as when a squatter first comes in?
I'm not saying that would be my first go-to solution for several reasons (violence, guns, drugs, cycle of vengeance, etc) but... for kicks 'n giggles... "Riddle me that, Batman." How is it any different if a squatter squats on a squatter?
Genuinely curious to hear thoughts...

DJ, look at the video. The part that I saw, all of the stuff was still in boxes, unpacked. The house did not look like someone was living there. That would have been in the LL's favor had the police come.

Sid--A squatter could squat on a squatter, if he were living in there long enough to establish residence. If the squatters left the place long enough to get in there and live there for a few weeks, yeah, you could do it. Unfortunately, squatters usually do not have much going on with their lives and basically hang around all day. Don, thanks for the thought; however, I'm going to play devil's advocate.
What constitutes, "establishing a resident?"
Also, you presume the police would check for such things. Don't they usually just respond, "It's a civil matter?" and leave it at that? Would it be up to a judge to determine if residency has been established?
I guess where I'm going with this ultimately is if you get the squatter to leave, go in, change locks and sit there with your buddies for a few hours and the squatter return... what are they going to do: call the cops? What will the cops do if they arrive, knock on the door, and you say, "Oh yes, this is my house and I live here. Here's my copy of the deed. Here's my insurance policy showing the address here. Here's my loan number with Big Ol' Bank showing my mortgage payment for this house. Here's a copy of my real estate tax bill paid on Dec 29th of last year."
And to counter this the squatter has.... nothing?
I'm genuinely curious. Anyone out there know how police actually handle this?

Sid, the police will generally tell them it's a civil matter unless it was a dispute call, then they have to make someone leave. It's up to the officer to decide who that is. In a domestic situation they will almost always go with a mother and child get to stay and the man has to leave. In this situation where there are no familial ties, I would bet they go with the one that can prove they should be there but they may go with the mother daughter. The hard part is not lying to them if they ask who's been here the longest. If you don't answer it then they will go against you, if you do answer it they will more than likely make you leave. Whatever you do don't lie to them, that is a criminal offense. --209.205.xxx.xx |

Mike--Lying to the FBI is a criminal offense, and they will use it to persecute someone who they know has not broken any law, go and ask questions and hope they catch their victim in what they can claim is a lie. That is why you should never talk to the FBI, even more so than other law enforcement.
It is not, however, a crime to lie to local and state law enforcement.
Sid--In Philly, residence can be established in 2 weeks, that is the rule of thumb the cops use. How can it be proven, or supported? Big piece of evidence is mail to the squatter at the address. First thing experienced squatters do is set up some mail to come. They may start utility service in their name. Their clothing being in the bedroom closet is evidence, too. --73.141.xxx.xxx |
