In Tn davidson co if a detainer warrant is filed- an in about 3 days after the tenant moves out an tells you their last day on the property is in 2days,an surrenders property before court date ,including turning off electric an water , -do I have

full legal rights to repossess ...

I would assume I do with all shes done to confirm leaving,but didnt know if between warrant served an court date I could take bk posession .

So Im just reconfirming.

Also if shes lost the deposit -due to break in lease, an condo is left clean, can I sue on that months unpaid rent an any late fees in full or is it likely I will have to account the deposit as Credit to unpaid rent?

clarify. Tenant tells you after 3 days they moved out? then say their last day will be in 2 days? Well they haven't moved out then.

Get them to leave a note that they are done and if possible a new address "in case some dep" needs to be returned. Leave keys on the counter for us. I'll send someone over to get them.

Thursday warrant received..then over the weekend iwas Told they will be out by midnight tonight..electric is set to be cut off monday along with water by tenant.

Thurday is court .

Tenacy also was terminated before warrant filed.

After tue when its surrendered- her text- an no electric or water is on can I go back into the unit ? Or will i need to wait till court though she surrendered it..?

An I had that 2nd question in 1st post.

Just to be safe, and it's just a couple days, and you really don't know, I recommend you print out all communication, notices, etc and take them to court on Thursday to show the judge the tenant has return the unit to you - and get the court's stamp of approval for you to clear it out, fix it up, etc.

You should also read and re-read TN landlord/tenant laws & see if its addressed there. Before court - so you don't say something really stupid to the judge.

Also contact the court clerk - ahead of time - and get some insight into what you need to file / re-file to change your case from wanting possession to needing financial reimbursement for damages, if appropriate. --68.229.xxx.xxx

Yes I have EVERY TEXT FROM LAST 5 MONTHS already printed an last few with her surendering property .!

I do have electric an water going bk in my name wed..an can exercise my rights to take care to inspect vacant property to avoid frozen pipes since its vacant ..

I got camera pics printed of her move out too ..

I doubt she will show in court..

You typically can't charge for the entire period that the lease would have been in effect. Instead, you can charge for the cost of getting the place ready, the time to rerent and the cost of marketing it for rerenting.

AT no time should the landlord be double dipping, that is unless the tenant agrees to pay for such a fee. ETF are opportunities for tenants to volunteer to pay for this scenario.

Im only asking for january- unpaid , the 2 late fees unpaid and court cost. When I filed she was residing there so I have not inspected it yet.

But I have her text from Sat the 4th --printed--that says "we will be out of the residence by midnight Sunday february 5th" -an the paperwork from the electric company that it has been disconnected there now.

Ill see if the keys are there inside once the water is off also.

Should I tell the office where I filed about this ? --50.240.xx.xxx
