I am eyeing up a property going up for Sherriff sale in NE Ohio. In doing the title search, I see the mortgage and a series of Medicare Liens. The bank is holding the sheriff sale.
How aggressive is the state at collecting on these liens. Since the first position is doing the sale, would the number two position get wiped out?

If the bank attorney notifies the lien holders properly then yes it will get wiped out at the foreclosure sale provided the mortgage was filed before the liens were, which is why banks require anyone getting a mortgage to pay off judgments like this. --74.77.xx.xx |

Triple check that. I think that Medicare (Medicaid?)gets paid first. Wouldn't the sheriff, or whoever is doing the auction, be able to tell you? They would know who they are sending the proceeds to.
The only one I've seen was in Oregon and the state had taken title and was selling to apply toward the Medicaid bill. There was no auction. They listed with a realtor. --76.178.xxx.xxx |

There is a Federal law that requires each state to try and get reimbursed for paying out Medicaid. Don't know if that makes them number one position or not. --73.120.xx.xx |
