Good morning everyone, one of our tenants informed us that her mom is in the process of moving out of state and her daughter

(our tenant) has allowed her to put her stuff in the garage and is staying at the house until she finds a home in the state where's she moving to.

Any recommendations on how to handle this? She's been a great long term tenant, but mom is not on the lease agreement, which is now actually a month to month. Do we create a new month to month adding her on and charging more rent?

I'm with Ken on this... keep checking in but it sounds like the tenant is up front on this and just letting you know. If there are additional expenses that you have because the Mom is there maybe charge a little more (and let them know) but other than that I think you should be fine.

Of course... this is CA I'm assuming so I don't know what those laws are... --69.201.xx.xxx

We love tenants that let us know these things. They aren't hiding things and want us to know that. For that they get rewarded.

If we REALLY knew EVERYTHING our residents are doing we could not sleep at night!

Pay the rent, take care of the home, and don't bother the neighbors.

I wouldn't worry if it's short term...but if it goes too long (maybe more than a month), I'd have her added to the lease for liability reasons and garnishment protection if she damages something. But, it might be good to tell the tenant NOW (in a nice way) that if she's there more than a month, you'll want to have her application and add her to the lease.

I know it's not a huge issue, but these things can in some cases mushroom. Let's say mom moves in...can't find a job or the place shuts down and mom decides she can't afford to move there, so she stays with daughter. Then 6 months from now, daughter moves out or dies and mom wants to stay. What do you do then? You've set a precedent by allowing her to stay with no documentation and so on. Or maybe they both stay and get in a fight, and both move out...you go in to assess damages and there is large damage...and the daughter says "I'm not paying for that, my mom did that"...and you can't hold mom responsible because she's not on the lease.

For the future, you should add a clause to your lease about guests...ours says 14 days max even if non-contiguous, in any 12 month period. If you think 14 is too little...fine...make it whatever you like. --99.92.xxx.xxx

Thank them for being honest and have them report back to you 30 days from now letting you know mom is gone. Let them know that a short 30 day stay isn't an issue, but if it is longer than that you may need to take additional steps --24.101.xxx.xxx
