I have a tenant on a 1 yr lease who again in a 6 mo period hasnt paid.They said they would on the 20th of jan[ i gave 7 day pay/quit notice. ..then on 20th didn't..an on 21st i texted again on it an they said-- no [ on paying] an we are moving]

I then left a notarised tn 7 daynotice to quit/ noncompliance with a ending date of sat 1/28 in the door .an that she is to out by then or it will go to court.. the pics an the cam at property shows she got there a hour after it was left..No response which is fine.

Didnt look like any moving done so far.

I waited a few days 26th an text her the text back[ w a copy of her text we are moving an pic of the notice] an asked her what at day are you moving an will be off the property?

No response...

Can I file today for the eviction or do i have to wait till that 7 day period i left her to move is over?

Next monday.

Any additional information is appreciated.

Shes had ample time an is a manipulator

Sounds to me like you need a local LL attorney to evict your tenant for non-payment. Don't try to DIY if you don't know what to do. --149.76.xxx.xx

Agree 100% with Barb. If you don't know the timing requirements for a Pay or Quit notice, then i'm afraid you'll run into a half dozen other issue, any one of which will cost you significant added time and expense.

Hire a pro this time and ask them the questions. The local attorney who specializes in evictions will know the answer, will give you accurate information, and then you can DIY your next eviction.

P.S. I've been a LL for 18 years and had over 20 eviction cases. I've always hired a pro. It's not worth my time messing around with tenants, timelines, court papers, mailings, postings, notices, etc just to save $350, which is the cost of the attorney's time. --184.4.xx.xx
