Hello, our daughter goes to ASU in Tempe AZ. She signed a lease starting August 2023. Her plans changed and no longer going to stay there. She found a new renter that has signed the lease, however, she needs to pay $500 release fee. They still have a few similar units that are now renting $200 over the price on her lease. She is breaking a lease that did not start yet. Since this is a different state and situation (University city) everything is different from what we know. I wanted to find out if this fee is legal. Please let me know only if you are sure as I am not familiar with students rentals (that all start in August) if this is legal. Thank you in advance --73.191.xxx.xxx |

The time to ask "is this legal" is BEFORE signing the lease, not after. Almost every contract (including leases) contain language that say, "This is a legally binding document. If you do not understand this, retain legal counsel."
I don't know if the fee is legal or not. It will depend on AZ state law, and it may also depend on the municipality wherein the rental exists. It may even depend on the JUDGE if you decide to take it to court if the law is silent or vague.
In my experience, $500 is a cheap "get out of lease" fee. I charge about double that...and it is due anywhere from 1 second after the lease is signed until 1 second before the lease ends if the tenant terminates early, regardless of whether or not the tenant moves in.
The reason for this is simple: landlords run a business. When we sign contracts, we expect people to keep to their word, and if they cannot or choose not to, then whatever we agreed to in writing is what we do. It sounds like you agreed to pay a fee if your daughter broke the lease, and it sounds like she broke the lease. Does the lease contain any exceptions if a new tenant is found or if she never moves in?
P.S. This is a landlord site mostly populated by individual landlords who are not legal experts. Any advice posted here is worth what you're paying for it. If unsure about your rights, I suggest that you retain legal counsel.

A lease is a legal contract. It doesn't say, hey, hold this for me because maybe I will take it in a couple of months or maybe I won't.
