I have a tenant that snuck in two pitbulls back in July and when caught he provided me with an ESA letter. After tiring of cleaning up the animal waste in my yard, receiving complaints from another tenant about noise, and damages in the unit including baseboards chewed up,plus excessive barking, and growling at my wife in the hallway, I issued a termination notice (no cause given-time in unit was less than a year)

The slug has now filed a complaint and it was assigned a case number with the enforcement division of fair housing and employment. They are giving me only 14 days to respond to very intrusive questions (24 of them), including names and phone numbers of every person that has lived in the unit! I am beyond sick of California, and am ready to sell out and move out of State. Any tips or advice? --73.41.xx.xxx

You need photos of the damages, the animal waste, etc. You need the other tenant to give you complaints in writing.

While you had to take the animals due to the ESA letter, you didn't have to allow your property to be abused, and once the damage started you needed to issue a cure or quit right away. So, now, you need to defend the non-renewal based on the damages and the complaints

Find a lawyer who does California Public Records Act cases for free - have him write up a Public Records Act demand letter and have the public agency respond before you respond. You need to know things like all public records about appeals, procedures, number of fines and cases per year, waivers, employee history of investigators and judges etc etc etc so you can exercise your rights. Knew a good CPRA lawyer but he retired during Covid. You shouldn't have to pay a fee since the lawyer gets paid if the government agency screws up their response or fails to respond. Hire an attorney who knows Housing Discrimination law. I know Mr. Landlord was sued once and he said it made all the difference - I don't remember details so I don't want to put words in his mouth but I remember it was a big deal. You are where I have been before! Many times. I've fought the fight against the Housing Department. The County Health Department. Section 8. The City Attorney. Building and Safety. REAP-Rent Escrow Account Program. Rent Stabilization. Discrimination complaints too. I've been found guilty without a trial and no allowed appeals, since the City sent Official Notice to the Former Owners, not me.

At first I hired an attorney who knew all of the players and their corrupt City Organization.

Then I hired a former Police Detective turned Private Investigator. He knew where all the dead bodies were buried, so to speak.

I learned I could not win playing their game. When I went to my City Councilwomen, Maxine Walters, she was going to help me since I was a provide for Low Income Housing in her district. But when she got my home phone number and realized I did not vote for her, I live out of her district, she hung up the phone and would not help!

Do Not Answer their Questions. Get an attorney and put them on notice.

I understand that landlords are commonly given 30 days to rectify complaints so I advise tenants that they have 30 days to pay for damages the same time table. You can live in CA and invest anywhere else. The question I have is why wouldn't you?

Btw, ESAs aren't allowed to act aggressively towards other people, poop everywhere, and cause damages. For this particular case, just document the reasons with pictures and be ready to show them to the judge. Maybe bring in a baggy of poop that you picked up for the judge to see and (if he/she allows it)... sniff.

Did the notice advise you of WHAT the discrimination complaint was about? You would think you would have that right if they didn't.

If it's in an apartment building, what does providing the names of all past tenants in that particular apartment have anything to do with the current tenant? Honestly, I don't even know why the past previous tenant names would have anything to do with a SFH either... It's a stretch for sure and the gov't likes to be very generic on things so you can hang yourself.

If they didn't provide anything I would ask. I wouldn't think they can just come up to you and say "hey, we have a discrimination complaint against you... here is a list of 24 questions we need you to answer right now" without telling you WHY or WHAT FOR. --69.201.xx.xxx

lawyer up. this is typical for the course in california. pitbulls are attack dogs and are a ticking timebomb that will rip the face off a kid sooner or later. i once asked a gang banger type if his pit was an extension of his male organ. he was too stupid to know i was taunting him. the neck tattoos were a sure sign of dullardness

at the risk of repeating myself, i NEVER EVER let animals be the topic of discussion. you see a pitbull? toss him a biscuit and move along. in truth i do keep a bag of biscuits in my truck so i can toss him one. i love dogs...that's my story and i'm sticking to it. let a few weeks pass and terminate the month to month tenancy. the multitude of ways tenants can make life hard for us and their neighbors requires that we also be conniving. the rules of the game are not made by us but we can play without getting gutted if we are prepared. my tactic is to have it NEVER be about the dog. --75.80.xx.xx
