State Specific Question About: NEW YORK (NY)

Starting an eviction process for a tenant that isn't paying rent or following lease provisions, for the non payment case I believe I can use certified mail for the 5 day late notice and then I need to use a process server for the 14 day rent demand and notice of petition / petition. Correct?

Concerning the other issues, I'm newer to this avenue. Is the proper procedure to give a 10 day notice to cure (certified mail or server?), then a 30 day notice of termination (certified mail or server?)?

I've looked all over and find conflicting information due to the 2019 'update'. I feel nycourts website isn't even up to date - hence my confusion. Any help would be greatly appreciated. --161.11.xxx.xxx

I would suggest hiring an attorney in NY,I used to do my own and a bunch of evictions for other landlords but since 2019 i am too confused to do them anymore.I know several attorneys who have stopped doing them because it has become so confusing.My suggestion for the 5 day notice is do both certified and regular mail,i do not believe certified is acceptable but if you do it both ways then the tenants cant argue whichever way you did was not legal.You need to send a letter saying rent is due,i believe this is intentional because they are just giving something for landlords to forget that the tenants can make the court start over.A 10 day is for squatters or someone who never owed rent but you need them gone.30 day notice is for eviction for other than rent owed.Where in NY are you? --74.77.xx.xx
