(9th circus) Judge allows Oakland eviction moratorium to stand, for now

The order is a blow to landlords who sued Oakland and Alameda County this year, but the case is not over.

A federal judge has denied an initial attempt by landlords to strike down Oakland and Alameda County’s eviction moratoriums, meaning the bans on removing tenants from their housing will remain in effect while a court case considering the policies’ constitutionality continues.

Judge Laurel Beeler’s order, issued Tuesday evening, is a significant step in a lawsuit filed by a group of rental property owners in March. The landlords argue that the city and county COVID-19 eviction bans, in place since March 2020, constitute an illegal “taking” of private property by the government and violate state law.

Beeler disagreed that the city and county are taking landlords’ property, writing in her 40-page order that the moratoriums “are temporary…do not absolve renters of their obligation to pay rent, and include exceptions allowing the landlords to leave the rental business.”

What is happening in Calgary Alberta is developers are building more rental housing along with converting existing structures to rental housing which benefits everyone. The pandemic is over where many tenants have the means to pay rent which is not constitutional in any democratic country; If someone is on social assistance they are able to pay rent or has a job they can pay rent. Even as bad as provincial government has not clear the backlog of cases here it is still possible to evict. As the population increases here Ontario is lagging in new rental construction compared to other provinces. That needs to end up in the supreme court. What happened in Berlin the roll back of rents was struct down by the German higher court where it known there is real hate for landlords there. Any business has a right to earn a income where if rent arrears are not inforcable then the right is taken away. If they did that to grocery within a week the grocery store would close down then the workers would be out along with no groceries for the community. --68.69.xxx.xxx

Another ruling in California was similar, a landlord losing only $20,000,000 (twenty million) since March 01, 2020 today, not including thing forward to February 2024. Saying this was only temporary and was for the good of the people (tenants) so they wouldn't spread the pandemic by staying put.

In the mean time California Landlord Insurance is up in double digits and also property tax is up too. --47.156.xx.xx

Retired tenants still not paying. The son applied for more ERPA money and says oh yes, it's coming. Mother happily told me that he did and that it will be coming soon. No sign of it. Son now may have a job. He's an IT guy but overweight and not able to get the vax due to heart issues. But local company interviewing him and it looks like he has it. Big five figure salary so I will make up a bill and hope he will pay it as he is on the lease also. The dad is having surgery in December after the holiday and I will let them know in the spring that they have to find other place to live if son does not pay what they owe. I have known them for almost30 years and the dad was in my elementary school. He met the mom when he was a crossing guard and she got scared by a preying mantis. Many years later they met again and married. Don't bash me as I won't read it. I have my ways and you have yours. --71.188.xx.xxx

I remember the time the Socialist Democratic government was elected in the province of Ontario where they brought in penalties for renovating and repairing rental buildings where one cold November day 20,000 jobs were lost as many building owners were going to change boilers to higher efficiency gas boilers where cancelled everything then the workers who were tenants who voted for the Socialist Democrats were promised no rent increases where the reality of losing a job was much worse where next election they were voted out. Often in provincial elections the Socialist Democrats last only only 4 years where never elected again. In the apartment building already bought two new gas boilers, a indirect hot water tank along with a electronic boiler control system where the existing boiler the gas valve went where contractor loaned me to keep heat while the new boilers and indirect hot water tank was being installed. At time spent $17,000 dollars with equipment and labour where using two boilers was more efficient along with a indirect hot water tank the standby loss is less then one degree per hour. As result of getting rid direct hot water tank which the gas valve was faulty, leaking carbon monoxide and was starting to leak the rental company was reluctant to replace. So natural gas consumption was reduced, rental of hot water tank and water softer, salt was reduced as no longer used water softner where that was reduction in operating costs. Fortunately no applied for rent reduction where understood the importance of having two gas boilers as one Sunday on the boilers broke down where waited until Monday to fix as parts were available. Even during February was able to heat building with the one boiler. No one can run economic and housing policy on left wing hate groups where they fail to see the whole picture on how that effects jobs, taxes and a economy which takes a hit under hostile legislation. If someone turned a rental complex to those hate groups within six months or less they would be bankrupt. --68.69.xxx.xxx

AllyM... I'd check the site for ERPA... here in NY ours is a one time only deal. I had a tenant try it... it delayed the process for a short time but they figured out that I was right (especially since it was on the site) and they started to pay but only one month. By the time we were about to go to court the "powers that be" denied their application because.... they already paid once".

I know you are in NJ and may just be waiting because it's winter and don't want to deal with a vacancy... but just be aware of that.... not sure if they are all the same. --69.201.xx.xxx

Perhaps the argument should be stated that the landlord request a moratorium on paying taxes since we have an "emergency" on our hands. When that is shot down, then it will be hard to argue back the other way --24.101.xxx.xxx
