My tenant is on subsidized rental and their contract states after initial year, contract converts to a month to month. Now, however, tenant is requesting a new lease, I'm not sure how to answer. Why would they need one? --99.113.xxx.x

If your lease says it converts then not much else to do except provide a brief note from your letterhead -The 12 month lease has completed- and now following HUD guidelines you are month 2 month, to request a rent increase you still have to follow the rules of your local HUD office. --76.190.xxx.xxx

Clarify with this resident if they are requesting a new lease (new terms and rent increase) or just simply requesting a copy of the current lease. If a government service is paying part or all of their lease then you'll have to follow their rules. I have several section 8 residents, all my residents renters have to prove to the school district a current lease and they don't want to school to know all their business plus the original HUD leases have their move in date, which could be several years ago, for one year, renewing each year, same paper, however the school doesn't recognize it as such cause there clearly is an one year end date. So I provide for these residents a one page simple lease, for one year, the deposit amount is lower, the rent higher, the numbers do not match, but it is for the term of the school year and it quickly satisfies the school need to verify their address and that they are living in the district with the rights to send their kids to that school. I would ask Why they need the new lease or a copy of the lease. --172.56.xx.xxx

Each of you, with different interests, would be protected against termination of the tenancy for the term of a lease. The tenant is protected against increase in price and termination of tenancy, and the LL is protected against a possible vacancy.

If the resident has successfully followed all your lease requirements, it is to your advantage and theirs to renew lease for an additional year, instead of converting to a month to month. --70.161.xxx.xxx
