Does the seller need title insurance on a seller-financed deal (with note and mortgage)? Seems like they wouldn't since they already got title insurance when the bought it. I am the buyer in this deal. Seems like the title company is just trying to sell more title insurance. 6x6 Seller being the lender requires the buyer to pay for a lenders policy,if the buyer wants the deal they will pay for it. if the buyer gets a mortgage with any regular lender like a bank they will pay for it also so nothing extra they wouldnt pay for otherwise.In a mortgage the borrower guarantees to the lender that the title is good and pays for a policy to back it up so in a typical seller financed deal the buyer is actually guaranteeing to the lender being the seller that the title is good,i realize that sounds backwards but that is how it works --74.77.xx.xx |

I don't understand why the seller would need to get another title insurance policy because they already got one when they bought the property, and they have owned it the entire time (until the moment that they sell to the buyer with seller financing). So if they got title insurance as the lender, it would be for the time that they've owned it (??)

YES. you need the place run through the paces to assure they are the legit seller, it is not previously encumbered, that the taxes are current...lots of reasons. in calif they pay for that to prove they are who they say they are. Lauren there are a million things that can cloud a title after someone buys it. mortgages, taxes, liens, heirs, easement...etc. buying a property without a title search and policy is insanity --75.80.xx.xx |
