A homeowner rents their basement out on month to month lease. The tenant has a dog. The homeowner has a dog. For 2 years now, the dogs have been allowed to go in and out of the home together or be together in the basement. The dogs got along the entire time.

Recently, when the homeowner dog was in the basement, the tenant dog attacked the homeowner dog and the homeowner dog had to go to the veterinary hospital.

1. Would the liability of $700 hospital bill NOT be on the tenant due to the homeowner knowing the risk or because it was in the tenant's DOMAIN?

2. To remedy, tenant can remove the dog, so how much time is reasonable to allow to remove the dog (1-2 months)?

3. Thoughts or personal experiences one would like to share?

Here very few of the basement apartments in houses are legal where no fire wall between heating system or wiindows can egress in case of fire. Dogs in multi residential properties are only going to be problems. Suppose no matter the cause then if there is a fire then homeowners insurance will not cover as the homeowner did not permits to conform to make the basement apartment legal. Being a dog owner while ignoring reality of two dogs. In the province of Ontario sometimes once a year there are serious fires in illegally apartments in houses where sometimes there is loss of life or serious injuries. Only a block from the house there are many of those type of apartments in houses where most of the people want a low rent where they do not care about safety. Most of the people are really low lfes who are on social assistance. Since install high resolution outside cameras in house no longer do they walk the dogs in front of the house as no longer have the dog mess on the lawns. While the system costed around $1,000 cdn dollars was meant to deter vehichle theft as the theives wanted steal truck. They drive up and down the street really slowly to get codes so a key fob can program then drive off where vehicles will end up for sale is Lagos Nigeria where the governemtn will not return stolen vehicles. A vehicle code can be picked for 200 meters which is 2/10 of kilometre. Since having a key which can use to lock then if any the buttons are not pressed then no code is transmitted. When I go to plaza I lock the truck with the buttons in vehicle so code is transmitted. or use keys. A lot of thevies will be in plaza looking for codes. The windows are really dark so can not see inside. Most countries in the world use kilometers and kilometers per hour where stolen vehicles the speedmeter does not have to be changed where here kilometers per hour is used. --68.69.xxx.xxx

There are a few different things to consider here. (You have cleverly concealed which side you re on)

- What caused the attack? Is the tenant's dog becoming aggressive in general, or was it the homeowner's dog who started it? How vicious was it / how bad were the injuries?

-Do the dog owners communicate well & can work things out reasonably? That would be best. Or, has this incident turned them into enemies - So now all communication is in writing & formal?

- Is it legal to be renting out the basement as a residence? It usually is not, unless there is a large window for emergency egress, & other things.

- If it is an illegal rental, and things escalate to go to court - whether for vet bills, eviction, or whatever, initiated by either party - there could be all sorts of legal and financial ramifications due to the illegal rental. Check your local & state laws.

As to your questions:

1) You could say it was the tenant's responsibility to keep everyone safe, because it was in their home with them supervising. One could also claim it's the homeowner's responsibility since the dog was "trespassing" or there without permission & the tenant's dog was defending its territory/owner.

I would say cooperation, communication, compromise would work out the best.

2) Unless the court orders it, nobody is going to get rid of their dog. Certainly not without holding resentment toward the other party. If it can"t be worked out, the tenant will need to leave and take the dog with them. How long this would take depends on many things. The legality of the unit - whether you want to go to court, and stop renting it; what type of rental agreement you have and what it says regarding giving notice. Since the tenant and the homeowner have this shared dog agreement of allowing them to play together. I would hope the dog owner who's pet did the damage would just step up to the plate and offer to pay the bill. At the very least half! Then I would start making other arrangements to keep the pets separated. --172.56.xx.x

Before animals came to the property the insurance declaration page would indicate where the owner would go to get the financial problem resolved when this liability surfaces such as has been explained here, best for owner to be named as an interested party so when the payment has lapsed the tenancy will as well. --76.190.xxx.xxx

Since I was not involved, I won't be able to fully answer any questions. The attach happened when the homeowner's dog jumped on the couch next to the tenant's dog (while in the basement rental unit).

The basement has an egress window.

Parties do get a long just fine.

The tenant would probably be willing to get rid of the dog since the tenant did not always have the dog during tenancy.

The responses have been very helpful.

Dogs lose their tempers just like people. Never let a small dog and a big dog hang out together. I would never have let the LL dog go into the basement with tenant dog. They have territories. Two stupids. I don't think anyone owes anything here. Dumb and dumber. --71.188.xx.xxx
