Landlords, in a quandary again. My month to month pita tenant (poor housekeeper, minor damages, not cooperating with needed repairs) has an outstanding warrant as of September 9th for a serious felony charge(s) including fraud and identity theft. He was served a NTQ for 10/1, and claims no where else to go, and will pay the higher amount required with the rental increase. This warrant makes me very ambiguous, because they are facing some serious jail time. The clincher for me is I am meeting tomorrow with a realtor to start marketing for my property for sale. Any advice on how to handle? Should I disclose this information to the realtor? Ask the tenant to vacate quickly knowing what I do? Realtor is confident he can sell the property expeditiously because the market is still pretty good around here. --70.158.xxx.xx

Call the cops and evict him while he is gone so you can throw his stuff out,or show up at jail and pretend to be surprised and offer him $100 for his commissary in exchange for his signature letting you throw it out or to give it to his mother for safe keeping --74.77.xx.xx

I would NOT market your property at this time. Once you have a first showing, you can never have another first showing. So others see your property re-listed, know you have issues and will NOT look at your property because of this.

From a landlord perspective = I would consider getting rid of someone strictly because they are PITA and a bad house keeper. Since they also the potential of jail time, I would want to ensure that an emergency point of contact actually exist.

As an investor - do you suppose having a potential jail bird in the building is increasing the value for the place? I understand that this person might be actually convicted, but you need to analyze this from a business perspective. Make sure that your local fair housing laws don't include felons though --24.101.xxx.xxx
