Arrrghh in Ma the law says we have to turn on the heat by Sept 15th! (It was over 80 today) but if you don't have it on and it gets cool,..below 68 during the day,..you can get fined,..and if you have been trying to evict a tenant, they can say that because they caused The BOH,..it is retaliation,..son one tenant turned off their radiators and opened up a window before the BOH guy showed up,..despite the only unit of 5 that was cold,..it worked,..gave them more months.

And no,..its NOT practical to have everyone have their own heating unit in this building as often recommended. ( I have other buildings that each have their own,,but again, not this building ,...for a number of reasons.

I have a building that each unit on the lower lever had a floor gas heater. Children drop plastic toys through the grill so when the heat is on it stinks. So I installed a 1/4" galvanized wire mesh below the grill so kids toys would go thru. So no the women from that household does not know what a vacuum is, uses a broom and sweeps dirt thru the grill and that makes things stink too.

So I provided an electric safe space heater and ran a circuit from the main panel to give each tenant a 20 amp outlet for this space heater.

So with a space heater (good for 1000 square feet) and a floor gas heater, Housing and the Courts wanted fine me. I said for what? I can't help it that my tenants live in the stone ages and throw trash on top of a floor furnace. So I provided them with a back up until I can get to the building and vacuum up the mess.

The judge said what can be more important than taking care of a tenants malfunctioning unit? I told the judge that the heater is not malfunctioning, instead it's user error -- I am a licensed plumber and heating guy and state the facts.

And the only thing more important than taking care of a tenant is: (A) Making my wife happy, (B) Taking care of my elderly parents, (C) Making sure my children are healthy, happy and in school getting good grades. The judge agreed with # (A). --47.156.xx.xx

When I lived up there in Revere for a couple years late 60s, there was no 80 degrees. Nastiest, icy, cold heatless unlikable place I have ever been. Here in NJ we had to turn on heat by Oct. 1. Now they say when the day time temps are below 68. We have had 85 degree days here in November.

In the apartment building avoided turning heat on and off where installed a Tekmare electronic boiler control system where there was outside sensor, indoor sensor, boiler loop sensor, indirect hot water sensor where Tekmar controlled two high effciiency gas boilers and temperature of indirect hot water tank. One February a tenant complained about where went up with a thermal camera then scanned radiator where was working in the double the temperature of the indoor temperature where the window was wide open. Brought her to boiler room where showed the one high efficiency gas boiler was constantly running where told I can heat the apartmet building not outside where walk around the block see if any windows are open. The cost of buying a Tekmar boiler system and insulating all the heating and hot water pipes in the basement boiler area will be recovered in lesss then one heating season. This September has been warm where not even turning heat in house or using wood stove as it is warm at night where the house still holds heats as insulation was upgraded. Not only does a electronic boiler save on fuel but also less wear and tear on heating system and electricity costs. Oil heat is much more expensive to heat then natural gas. Where if natural gas is available woulld look at changing out as high effciiency gas boilers are at 95 per cent efficiency. The worst is the indoor outdoor bimetal boiler control as windows are open then system cranks up. --68.69.xxx.xxx

Mark, as I read the regulations (410.200: Heating Facilities Require & 410.201: Temperature Requirements of 105 CMR 410.000: MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION (STATE SANITARY CODE, CHAPTER II)), you only have to provide the means to achieve the required temperatures. If your tenant decides to lower their Tstat, open windows, close off radiators / vents then it shouldn't be a LL violation. Since this is a multi, you should be able to show the BOH inspector that the heating equipment is functioning properly, that the other units have heat & that the only reason this unit doesn't is because these tenants are messing with it. --71.184.xxx.xxx

As there is global warming temperatures are higher where the heating season is shorter where only sometimes the outside temperature will fall wheee the heat is required. Most rental complexes here owners have improved the building envelop where new windows along more insulation less heat is required. With combination of building improvements along with electronic boiler controls heating season is determined by outside temperature where with electronic boiler controls if required the heat would even come on in August if required therefore the heat is never turned off. With incrrased energy costs improving efficiency is no longer a option. --68.69.xxx.xxx

Tonight the outside temperatures are starting to drop to seasonal levels where at the house have turned on heat as the inside temperature is still 23 degrees Celsuis well above the normal room temperture of 20 degrees Celsius. The DIY two can spray foam is starting to show results where going to apply more before it is too cold to do so. The worst is removing the garbage moldy fiberglass insulation which is the worst insulation out there. In the walls what happens with fibreglass is there is air pockets then mold along with insulation has lost value. They still that garbage insulation here Roxul batt or spray foam is more expensive where in reaity insulation value does not deteriorate over time. Low E double or triple pane windows will keep more heat in. Complaining about the higher natural gas or oil heat does not resolve where a plan to reduce heat loss and heat gain in summer if have Ac can be done in increments. If natural gas was available it would be expensive where one suite at a time install a high efficiency gas wall mounted boiler on wall then vent directly outside then the heat the tenant would control and pay for electricity and natural gas they use. --68.69.xxx.xxx
