For years our policy of not accepting self employment has worked well for us, saved us from chasing people who cannot be garnished.

Today's applicant works at Target (good!) but wants us to count her income from OnlyFans.com . She has screen shots to show $1500 per month income from this site.

This site is basically babes in tights doing exercising or makeup tutorials. People subscribe to that person's channel for a fee.

Tons of Content Creators are making HUGE million dollar incomes with videos on YouTube, paid by advertisers per view and picking up endorsements.

Should we count this non-garnishable income??

Is it garnisheable? We'd need to find out how to send in a judgment. A lot of these sites only require a bank account or a reloadable debit card and they send money to their independent contractors. YouTube and other online content hosting sites are not employers; therefore, the question we need answer is whther or not they are bound by garnishement laws. I'm guessing "No".

Even if they are, where would the sheriff/local constable serve the garnishement papers?

Here's my thought: you need their BANKING info and also keep a tight leash on payments. If they're making serious money ($1500/month is serious enough for me), that's going straight into their account probably on a daily, weekly, or bi-weekly basis. You want access to is immediately, so set them up on daily or weekly payments if you have access to auto-charge/debit software, like Buildium or an ACH service.

Then if they get evicted or leave damages, if you still have their bank info, you can seize and levy their account. Those online services won't pay cash, so the tenant will eventually have to establish a bank account somewhere. If you've got access to skip trace service....boom!

So yes, I would consider it income, because of the tools I have at my disposal to ensure I can still get to the funds. But for the regular ma and pa land lord who picks up cash by knocking on the front door or waits for a check in the mail, I would not recommend considering it. Too hard to find if you aren't tech/bank savvy.... although one could use a quality Collection agency who has access to the right tools.

Garnishable is the point. Being able to garnish is like insurance on getting paid.

We bring in a few thousand a month on old debt being paid thru garnishments.

LLs who complain about not being able to collect are probably not requiring a garnishable paycheck because it's so simple to garnish in my state.

I threaten my kids that I am going to set up one of those accounts but they must do the computer stuff since I'd mess it up. That brings about the smirks, remarks, comments, sneers, giggles and threats of the old people's home. BUT, one of my daughters knows someone who does similar with foot photos and she makes several thousand a month !!! I called bull c***. My daughter apparently has seen the bank statements because this girl tries to get everyone else to set up accounts due to the ease and amount that can be generated.

Years ago, early internet, we rented a large house to 2 adult couples. Everything was fine until they disappeared.

At move out we found a bunch of credit card PAYOUT statements showing lots of people who paid them - names of prominent citizens and many many more.

They were doing phone “conversations” and $X.XX per minute under the name VELVET ANGELS.

If you saw them these women were the farthest thing from sexy!

I would not count it...unreliable and they likely are not paying taxes on it...thieves that don't pay taxes...that's why we always tip at bars/restaurants on our credit card rather than in cash...so it shows up as income to the server. --99.92.xxx.xxx
