Some applicants/tenants are stating to have an "Emotional Support Animal" to hopefully avoid the No Pet clause. They have stated that they do not have to pay the extra pet rent or pet deposit. Has anyone experienced this? Thanks --173.167.xxx.xxx

Some people claim to have several animals and somehow they are all ESA? I guess the ESA needs an ESA?

I think you can find the laws pertaining to this on this site, but I can't remember where. You can also do a search for the topic ESA in the search bar above and can read all of the post over the years. The laws have improved a little over time.

I believe Ken is correct in that you can most likely find other legal reasons to deny the person. Verify the humans fist. You may want to rent to the animals and leave the humans out.

I'm reposting this,

I'M generally not one for more laws, BUT I think there needs to be some type of law that says any Dr can write a note calling a pet a comfort animal. I saw a young lady that was taking a large turkey on a plane, stating she had a Drs note that it was such, and she needed to travel with it.

So a dentist and any Dr can write these notes without any tests/justification of why they really need it.

It's no skin off the Drs nose just to write these. If it required testing, a real criterion of need and paperwork for the justification they might not randomly say "yeah,..here's your note" which would take seconds to do.

Also, there should be a place where you can check on service animals. Right now you can pay a fee and get a phony "certificate" that your animal (esp dogs) that it is indeed a service animal and get a vest that shows it, so all can see when you walk into a store etc.

What store owner or clear would ever ask/challenge if it was real? -

An emotional support animal is NOT the same as a service animal.

Still, we never decline on this basis. We always select better qualified applicants. Our experience has been that 100% of our applicants with "emotional support animals" are trying to scam their way around no pet rules. Thankfully scamming people don't have the best applications

Had a student move in with a pit bull that had not been previously approved. There was nothing I could do when she produced a letter from a counselor stating her need. The whole thing was highly suspicious the way it went all went down. Their lease was not renewed. They were very difficult tenants through their entire tenancy.

Your best bet is to do that search at the top. There have been so many discussions on this topic. I wouldn’t be surprised if there was a new one every week for the last 3 years. --76.179.xxx.xx

ESA is the new biggest SCAM. Everyone is 'special' and are excluded from the rules. It's a shame, cuz it's meant for people who really need them, not just people who want a dog.

Doctors are just to blame. They know the person doesnt really NEED the dog, but they don't want to bother with them so they write a letter to make the person go away.

The way to dissuade them is...

- Make them provide the doctors letter saying they need it

- if your town/city requires dog registration, make them provide you copy of it.

- make them provide you copy of the dogs animal vaccination.

- make them carry renter's insurance

They will most likely balk at the first two. Especially the registration. --73.17.xxx.xx

Month to month lease. All I am doing now. I ask on application if they plan on adding any roommates or "animals" as occupants in next 90 days. If an ESA appears with paperwork after move in, they lied on application. Grounds to end lease for me. That helps with the 'silent' boyfriends as well. Since I have cut my units in half after my crystal ball told me Landlording is doomed for likely the next decade, I am also willing to end the tenancy and sell. --216.23.xxx.xx
