I am buying a house from a young couple who have been in a forbearance for a year.Everything is coming due soon and they no ability to pay it,they couldnt even start making regular payments again.There must be a lot of people in this situation.Does anyone have an idea how to find a list of owners in this situation? that would make a good list to mail --74.77.xx.xx

Not as easy as it seems. Stubborn owners, difficult lenders and a million so called "investors" trying to steel the deal from under you.

I usually wait until the owners have been served with foreclosure papers. Then I try to work out a "Short Sale" between myself (buyer), owners and lender. --47.156.xx.xx

The key is when does a lender enter into a forebearance agreement. Here, they can't foreclose until you are three months behind. Not sure if that is actually the law or just a customary procedure. If they enter into the agreement during months 1-3, I can't imagine how you would find them. I can't imagine they enter into it once the foreclosure is filed but perhaps.

Best I can think of off the top of my head would be to place an ad in which you specify those currently in forbearance in same spots where people advertise to buy property in

"as is" condition. There might not be any court record or document recorded when they do forbearance but I don't know. If not, I don't know how such a mailing list would be created.

Ray,

Let us know whether he offers to leave the tip. Also, I have the feeling he will tell you he doesn't get involved in those transactions at the branch level.

Ken, have you looked at one of the Pre-foreclosure lists that are for sale on-line? It would be interesting to see if the property you just picked up is on there, if so, then there might be others on the list mixed in with the normal junk. --47.37.xx.xx

Mike,i dont buy pre foreclosure lists,i create my own,when MERS is involved and someone misses 2 payments the bank does an assignmnt of mortgage to get the mortgage assigned to the correct bank in order to start the foreclosure process,I mail that list.

Nicole- I am not sure,i would assume it was at various points before or after missing payments,traditionally the banks start a foreclosure action after 3 missed payments but i regularly speak to people who are 2 years behind and the bank has not started anything yet,i met a guy once who said he was 7 years without making a payment and nothing had started yet.I am also seeing where banks have released a mortgage,acknowledging payments were not made but they didnt want to hold a mortgage any longer and more recently i am seeing foreclosures start,get released and a satisfaction of mortgage being filed with no deed showing a sale,i am seeing that often enough that i do not believe these people are somehow coming up with the money to pay off the mortgage --74.77.xx.xx
