gm, my long time tenant, who takes in roommates without written agreement, wants a roommate to leave. What are her rights, what recourse does she have to remove this person? thanks --68.129.xxx.xx |

Tell her to call her lawyer. Any info you might give her, if it does not work out like she wants, she may well use against you. You just don't need the potential hassle. --24.180.xx.xx |

After this person gets rid of the problem, you do the same - get rid of this person, they need to own a place, while you get a better client. --76.190.xxx.xxx |

When you evict her, be sure to include "all Others in possession" - or whatever magic word is needed in NY to be sure they ALL are ejected --68.229.xxx.xxx |

Landlord Friend had an issue where main (good) Tenant's roommates refused to leave, saying they had possession. Cops agreed - main Tenant had allowed them to move in.
So Friend ended main Tenant's lease (they were M2M) and they moved their stuff to storage and stayed with friends for a bit.
Friend called the cops on the roommates - whom he did not know and they didn't know him - who could not produce any proof they lived there (no lease, no utility bills, etc.) Cops evicted them as trespassers and allowed Landlord to change locks.
Then old Tenant moved back in.
It was a hassle - a lot of moving about - but it worked. --50.82.xxx.xxx |

thank you all. WMH, I suspect this is the path that may need to be taken. To be continued.... --68.129.xxx.xx |

My tenant gave her roommate a written notice to leave. When that did not work, she talked to the police who told her to have her Landlord post an eviction notice. After I posted notice on the door, he was out within 3 days. --75.106.xxx.xxx |

Why do you allow sub lease??? You have lost control of your property. Does your authorized tenant have the ability to pay for a total reconstruction when the the sub-lease destroys the property??? It can happen very quickly. --76.138.xxx.xxx |
