Does anyone know if ERAP is still paying in NYS? We have a couple that has used COVID to not pay for 2 years and have racked up quite a bill. Despite good income.

I'm afraid we find that our lawyer is very lazy and has collected her substantial fee for doing almost nothing and now saying NYS is out of ERAP money so don't expect anything,

That the breadwinner quit or was relived of his original job during the pandemic ,and was being well being paid,.. under the table for about that time. However right before that ,..the month before they (NY) was saying they still were paying in the month prior if people had applied (which they claimed they did). but it will take time to process.

I think our lawyer rather not pursue any more work on this and happy to the little she has and is happy with her bill that has been paid.

If someone applies to ERAP (which is called RAFT in other states),.you have to stop evictions. But ERAP won't give us any information on the status, citing privacy, and now these people have moved out.

But he is claiming no income while according to people that know him, he is paid very well under the table,..

I'm wondering if we have a weapon tool with telling him if he doesn't pay or make a signed contract payments or we might alert the IRS on both him and the employer, as this has to be purposeful tax fraud...

Well yes,..I know the agencies don't care,..but perhaps the local DA might, esp if we say we will be talking to a news reporter if no action is taken, as well as the few politicians that seem at least to the public that seem to care about fraud.

Also the IRS,..again,.. maybe as a tool,..(would you like a person that did know you have a long history of purposely cheating on your taxes, and alerting the IRS?

In looking up the status of ERAPT,.i t seems to say that it has been re-instituted at least for now.

If they applied for ERAP prior to 3/31/2022 then you should get money ... no guarantee though. HOWEVER - I don't know if you will be paid for 2+ years ... they typically will only pay up to 15 months.

Don't tell them (ERAP) that the tenant left ... if you pulled their application to you then you have the information. All you have to do is update the forms. If they are not there now, just don't ask for the money for those months.
